At the end of the course participants should fully understand the financial requirements in Appendix FM and the related evidential requirements in Appendix FM-SE, and be equipped to handle a range of applications involving different financial circumstances. 

Topics will cover the requirements for partners and other family members under Appendix FM and Appendix FM-SE, including: 

  • Calculating level of income/savings required 
  • permitted sources of income 
  • specified evidence 
  • methods of calculating salaried employment, self-employment, non-employment income and cash savings
  • combining sources of income
  • adequate maintenance test
  • new rules on “other sources of income, financial support or funds in exceptional circumstances”
  • case studies

Tutor biographies:

Nath is a solicitor at Wesley Gryk Solicitors LLP. Her practice covers a wide range of immigration, asylum and nationality law, with particular emphasis on applications based on partnership, family and private life; asylum on the basis of sexual identity; and the rights of Europeans and their family members. Nath also volunteers for Queen Mary Legal Advice Centre and UKLGIG; writes regularly for Free Movement; and is a JCWI trustee.

​​​​​​Adam is an associate in the immigration team and has practised immigration law for over eight years. Advising on the full range of UK immigration and nationality law matters, he has particular expertise in assisting EEA and third country nationals on their private and family immigration matters, including partner and parent categories, long residence, visitor and nationality applications. He also has a strong track record of successfully challenging Home Office decisions on appeal in the First-tier Tribunal. His recent work has involved supporting high net worth individuals on points-based system applications, including Tier 1 investor and entrepreneur routes. In addition, he advises businesses on obtaining sponsor licences and corporate clients on Tier 2 sponsorship compliance matters. Adam is a volunteer for UKLGIG where he gives pro bono advice.He is also a member of the diversity and inclusion committee at PMC and is team leader for the socioeconomic subcommittee.

Aim of Course:

To provide an overview of the financial requirements for partner-based applications (5 year track) for entry clearance and leave to remain made under Appendices FM and FMSE, and to explore in detail aspects of those rules.

Spaces Left:
The session is aimed at those who are already practising in this area, and will assume working knowledge of the structure of Appendix FM within the immigration rules.
