SUMMARY:WEB 3162 Criminality issues in Visitor Visa or ETA Applications
DESCRIPTION:Book tickets now \nOverview: This training session will equip practitioners with the knowledge and practical tools to navigate these issues effectively.\n\n\n\nLevel: Basic – Intermediate \nImmigration practitioners are increasingly encountering challenges where the Home Office adopts a strict approach to visitors with historic criminal convictions—often refusing to exercise discretion except in rare cases involving high‑profile individuals. This shift particularly affects non‑visa nationals\, and those from countries with higher rates of criminalisation such as the US\, where historic convictions are more common. The impact is now being felt across sectors\, from sport to entertainment\, and has led to a rise in pre‑action protocols and judicial review activity. Engagement with UKVI remains inconsistent\, with decisions often varying on a case‑by‑case basis. \nTopics include: \n\nUnderstanding the full life cycle of a visit entry\, and key differences between the visitor route and ETA applications\nCriteria most likely to trigger refusals or increased scrutiny\nPractical troubleshooting guidance\, including arguing discretion and case studies\nSector‑specific considerations for business visitors\, creatives\, and sportspersons\nCriminality crossover issues:\n\nComparing criminal convictions and systems in the US and UK\nApplying to delete police record data\n\n\n\n\nRemedies and next steps for challenging adverse decisions\n\nAudience: \nThis course is designed for immigration practitioners who advise on visitor visa and ETA applications. \nTutors: \n\nKate Newbury\, Partner\, Kingsley Napley (Immigration law)\,\nEdward Jones\, Senior Associate\, Kingsley Napley (Criminal law)\,\nMatthew James\, Senior Associate\, Bates Wells (Immigration law)\n\nKatie Newbury is a Partner at Kingsley Napley. whose practice encompasses the full spectrum of individual immigration matters. SUMMARY:WEB 3161 Challenging the Certification of Asylum and Human Rights Claims
DESCRIPTION:Book tickets now \nOverview\n\n\n\n\nThis course will be a practical and interactive opportunity to understand and embed the law and policy related to asylum and human rights. \n\n\n\n\nLevel: Basic to Intermediate \nDescription: \nThe Home Office are increasingly certifying claims as clearly unfounded under Section 94 of the 2002 Act. \nThey also certify claims under Section 96 on the 2002 Act\, where they believe that an applicant could have raised an issue in an earlier appeal and failed to do so without good reason. \nCertification under these provisions has a huge impact on applicants\, by preventing them from appealing negative decisions in the FTT. \nIt is therefore vital that we all\, as practitioners\, develop strategies to successfully challenge these decisions as they arise. \nThis course will be a practical and interactive opportunity to understand and embed the law and policy around the certification of asylum and human rights claims. To successfully challenge them. \nAudience: Those involved in asylum seekers and human rights claims. \n\n\n\n\nTutors: Bahar Ata\, Director of Immigration and Public Law at Duncan Lewis Solicitors and Raggi Kotak\, Barrister at One Pump Court \nBahar Ata is a Director of Immigration and Public Law at Duncan Lewis Solicitors. She leads a team of lawyers who often challenge the certification of asylum and human rights claims. \nBahar has been involved in a number of high-profile challenges against Home Office decisions. \nRaggi Kotak is a barrister at One Pump Court Chambers\, practising in the Immigration and Public Law teams. \nShe regularly and successfully challenged certified decisions. \nRaggi likes to think of herself as an excellent trainer\, providing fun and interesting learning opportunities to ensure we all have the tools and enthusiasm to fight legal injustices. \n\n\n\n
