DESCRIPTION:Book tickets here \nAn overview of civil penalties including what measures can be taken to potentially challenge decisions and the legal process of appeals. \n\n\n\n\nWith a surge in the number of civil penalties being issued for illegal working\, as well as the maximum penalty now being £60\,000 per worker\, and with the planned extension of the right to work scheme to contractors and the GIG economy\, immigration practitioners might expect clients to encounter civil penalties more often. Together we’ll explore the financial requirements of Appendix FM. \n\n\n\n\nLevel: Intermediate \nDescription: \nAt the end of the course participants should fully understand the financial requirements in Appendix FM\, the transitional arrangements in place for those who started on the partner route pre-April 2024\, and the related evidential requirements in Appendix FM-SE\, leaving them equipped to handle a range of applications involving different financial circumstances. \nTopics will cover the requirements for partners and other family members under Appendix FM and Appendix FM-SE\, including: \n\nnew minimum income requirement and transitional provisions\ncalculating level of income/savings required\npermitted sources of income\nspecified evidence\nmethods of calculating salaried employment\, self-employment\, non-employment income and cash savings\ncombining sources of income\nadequate maintenance test\nother sources of income\, financial support or funds and the differing exceptionality tests\ncase studies\n\nThe aim of this course is to provide an overview of the financial requirements for partner-based applications for entry clearance and leave to remain made under Appendices FM and FM-SE\, and to explore in detail aspects of those rules. DESCRIPTION:Book tickets here  \nLevel: Intermediate – Advanced \nCourse Type: Overview \nDescription: We will explore issues that arise when organisations with complex structures apply for Skilled Worker and Global Business Mobility sponsor licences. \nThe high level of recent merger\, acquisition and restructuring activity in the UK means practitioners are frequently being asked to advise on the immigration and right to work aspects of corporate transactions. Where one or more of the entities involved has a sponsor licence\, this will often consist of reviewing the current sponsor licence arrangements\, advising on the appropriate arrangement post-transaction and then taking the necessary steps to ensure that the appropriate entity is able to continue to employ its sponsored workers. This may involve either making a notification to the Home Office or submitting an application for a new licence. If the transaction involves staff transferring between entities\, this can also involve right to work issues. \nPractitioners are also frequently required to have an understanding of the types of structures that international companies employ and advise on whether these structures mean that these businesses can transfer their overseas employees to the UK under the Intra-Company routes (including Global Business Mobility – Senior or Specialist Worker). \nThe course will explore issues that arise when organisations with complex structures apply for sponsor licences. It will consider the steps that need to be taken when an organisation that holds a Skilled Worker sponsor licence is involved in a corporate transaction. Finally\, it will look at the right to work issues that arise from corporate transactions. \nTopics: \n• Initial sponsor licence applications\, with a focus on Skilled Worker and Global Business Mobility routes; \n• Adding new UK and overseas group entities to a sponsor licence; \n• Qualifying types of corporate group structures for the Global Business Mobility routes; \n• Recognising and dealing with common change of ownership scenarios; \n• Worked examples of the steps that practitioners should take when notifying the Home Office when a sponsor licence holder is involved in a corporate transaction; and \n• Right to work and due diligence issues which arise as a result of corporate transactions. \nBy the end of this course you will gain an understanding of the requirements relating to qualifying linked entities for the purposes of Global Business Mobility licences\, be able to identify relevant changes to corporate structures as well as understand the appropriate action to be taken in respect of such changes. \nThe course will not cover: \n-Step by step guidance on reporting or submitting change of circumstance requests \n-In-depth guidance on general sponsor licence application requirements and documents \nAudience: This session is aimed at practitioners who have existing knowledge of sponsor licence applications and are looking to broaden their understanding of corporate structures and the steps that need to be taken from an immigration standpoint before\, during and after the completion of a corporate transaction. \nTutors: Robert Houchill and Kate Harding at Kingsley Napley. \nRobert Houchill has extensive experience of assisting individuals and organisations with their UK immigration and nationality matters. Robert’s experience covers all kinds of immigration and nationality applications but with a particular emphasis on corporate immigration matters. \nRobert often helps organisations with sponsor licence applications and advises on immigration compliance issues. He has also worked with organisations to challenge UKVI decisions following sponsor licence suspensions and revocations. \nPrior to joining Kingsley Napley in March 2019\, Robert worked for five years at law firms in London\, including Gherson and Bates Wells Braithwaite\, and at a Russian law firm in St Petersburg for two and a half years. \nKate Harding has extensive experience of assisting individuals and corporations with their UK immigration and compliance needs\, particularly in the technology and financial services sectors. SUMMARY:Challenging Civil Penalties
DESCRIPTION:Book tickets here \nWith a surge in the number of civil penalties being issued for illegal working\, as well as the maximum penalty now being £60\,000 per worker\, and with the planned extension of the right to work scheme to contractors and the GIG economy\, immigration practitioners might expect clients to encounter civil penalties more often. The group aims to improve access to the sector to counter the limited diversity among immigration practitioners particularly in senior roles\, to address the systemic racism prevalent in the sector within immigration systems and workplaces\, and to help foster a more welcoming environment for racialised practitioners. \nThe Working Group intends to work on fostering an inclusive culture where discussions on racism can take place and how these could be embedded within the workplace so that issues can be made explicit then addressed rather than remaining unacknowledged. \nThe ILPA Racial Justice and Equality working group is first and foremost a space for our Black and Ethnic Minority members\, as a collective space for thoughts\, frustrations and action.
