DESCRIPTION:We will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences.\n\n\nLevel: Intermediate – Advanced \nCourse Type: Overview \nDescription: \nWe will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences. \nThe high level of recent merger\, acquisition and restructuring activity in the UK means practitioners are frequently being asked to advise on the immigration and right to work aspects of corporate transactions. Where one or more of the entities involved has a sponsor licence\, this will often consist of reviewing the current sponsor licence arrangements\, advising on the appropriate arrangement post-transaction and then taking the necessary steps to ensure that the appropriate entity is able to continue to employ its sponsored workers. This may involve either making a notification to the Home Office or submitting an application for a new licence. If the transaction involves staff transferring between entities\, this can also involve right to work issues. \nPractitioners are also frequently required to understand the types of structures that international companies employ and advise on whether these structures mean that these businesses can transfer their overseas employees to the UK under the Global Business Mobility routes. \nThe course will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences. It will consider the steps that need to be taken when a company that holds a Skilled Worker sponsor licence is involved in a corporate transaction. Finally\, it will look at the right to work issues that arise from corporate transactions. \nTopics: \n• Initial sponsor licence applications\, with a focus on Skilled Worker and Senior/Specialist Worker licences; \n• Adding new UK and overseas group entities to a sponsor licence; \n• Qualifying types of corporate group structures for the Global Business Mobility routes; \n• Recognising and dealing with common change of ownership scenarios; \n• Worked examples of the steps that practitioners should take when notifying the Home Office when a sponsor licence holder is involved in a corporate transaction; and \n• Right to work and due diligence issues which arise as a result of corporate transactions. \nBy the end of this course you will gain an understanding of the requirements relating to qualifying linked entities for the purposes of Global Business Mobility licences\, be able to identify relevant changes to corporate structures as well as understand the appropriate action to be taken in respect of such changes. \nThe course will not cover: \n-Step by step guidance on reporting or submitting change of circumstance requests \n-In-depth guidance on general sponsor licence application requirements and documents \nAudience: This session is aimed at practitioners who have existing knowledge of sponsor licence applications and are looking to broaden their understanding of corporate structures and the steps that need to be taken from an immigration standpoint before\, during and after the completion of a corporate transaction. \n\n\nTutors: Robert Houchill and Kate Harding at Kingsley Napley. \nRobert Houchill has extensive experience of assisting individuals and organisations with their UK immigration and nationality matters. This will not only include practical advice on how to obtain a sponsor licence but also how to ensure effective compliance and retain the licence. We will discuss the submission process and compliance requirements\, highlighting pitfalls and providing tips. We will advise upon the HR practices necessary to ensure sponsor duties are met and other factors that the Home Office would be looking for at a compliance visit. We will also discuss our experience with sponsor license refusals\, downgrading and revocations – providing tips for avoiding these and challenging them where necessary. \nAudience: \nThis course is designed for business immigration practitioners and HR specialists who advise on sponsor licences. \n\n\nTutors: Smruti Jeyanandhan\, Bates Wells and Sam Ingham\, Laura Devine Immigration \nSmruti Jeyanandhan is a UK immigration and nationality law specialist with over 18 years’ experience advising corporate and private clients on complex business and personal immigration matters. \nSmruti has significant experience in delivering strategic solutions-focused advice to employers on sponsor licence applications and employer compliance support. Smruti regularly advises on sponsored as well as self-sponsored routes and provides an end-to-end service to ensure each individual feels supported throughout the process. DESCRIPTION:We invite you to attend ILPA’s first Student Sponsors Conference\, hosted as a hybrid event. This all day conference will take place in person at Friends House in London and online via Zoom. Together we’ll explore the financial requirements of Appendix FM.\n\n\nLevel: Intermediate \nDescription: \nAt the end of the course participants should fully understand the financial requirements in Appendix FM\, the transitional arrangements in place for those who started on the partner route pre-April 2024\, and the related evidential requirements in Appendix FM-SE\, leaving them equipped to handle a range of applications involving different financial circumstances. \nTopics will cover the requirements for partners and other family members under Appendix FM and Appendix FM-SE\, including: \n• new minimum income requirement and transitional provisions \n• calculating level of income/savings required \n• permitted sources of income \n• specified evidence \n• methods of calculating salaried employment\, self-employment\, non-employment income and cash savings \n• combining sources of income \n• adequate maintenance test \n• other sources of income\, financial support or funds and the differing exceptionality tests \n• case studies \nThe aim of this course is to provide an overview of the financial requirements for partner-based applications for entry clearance and leave to remain made under Appendices FM and FM-SE\, and to explore in detail aspects of those rules. DESCRIPTION:This course will focus on settlement (indefinite leave to remain) applications in the family\, private life and other human rights routes\n\n\nLevel: Intermediate \nDescription: \nThis course will focus on settlement (indefinite leave to remain) applications in the family\, private life and other human rights routes including long residence and will also cover EUSS\, UK ancestry and BN(O) Hong Kong applications. It will include consideration of general issues such as Life in the UK/English language requirements\, criminality and other general grounds for refusal\, continuity of residence\, qualifying periods and Covid 19 discretions as well as the mechanics of applications\, appeals and maintaining ILR including returning resident applications. \nThe aim of the course is to provide practitioners with a clear overview of the current measures\, policy guidance and any concessions in place to enable them to fully advise and prepare clients who are applying or considering applying for settlement in family\, private life and other human rights routes. \nAudience: \nThe session is aimed at practitioners either with prior knowledge and experience of family\, private life and other human rights applications who are looking to refine their knowledge of this area of practice or who wish to expand their knowledge of areas which they do not routinely work in. \n\n\nTutors: Emma Cohen\, OTB Legal and Meghan Vozila Penningtons Manches Cooper \nMeghan and Emma’s training for ILPA has been described as “excellent” with delegates valuing the “useful sharing of experiences“. \nEmma is an associate solicitor at OTB Legal\, a niche immigration law firm in Nottingham. She previously worked in the immigration team at Bindmans LLP for over thirteen years. She covers all areas of immigration\, asylum and nationality law. She has particular interest and experience in complex immigration and nationality cases involving families and children including inter-country adoption and she regularly writes court reports on immigration issues in family cases. Emma is recognised in Chambers and the Legal 500. \n Emma qualified as a solicitor in 1995 at Bates\, Wells and Braithwaite where she was later a partner in the immigration department. Although she has spent most of her post qualification experience working in immigration law in private practice Emma has also lectured at Anglia Ruskin University in Cambridge and worked in the voluntary sector. She is a volunteer adviser for Rainbow Migration. \nEmma is a regular trainer for ILPA and had delivered courses on Nationality Applications for Children\, Indefinite Leave to Remain: all you need to know\, Criminality and the Immigration Rules\, Family Law for Immigration Practitioners\, Professional conduct and ethics in immigration cases\, Home Office policy\, concessions & the exercise of discretion outside the rules\, and Discretion – What’s Left? Exploring the use of discretion in immigration and nationality law. She has also spoken at ILPA’s conferences on family migration. \nMeghan is a Partner in the Pennington Manches Cooper’s immigration team. She is experienced in all aspects of immigration and nationality law. She provides in-depth advice to a range of clients including SMEs\, large multinationals\, high-net-worth individuals\, high-profile celebrities\, tech firms and entrepreneurs. Meghan has particular knowledge of complex European and UK nationality matters and regularly assists both private and corporate clients with tailored solutions. \nIn addition to being recognised by Who’s Who Legal and The Legal 500 as an expert in UK corporate immigration\, Meghan has also been highlighted in Chambers HNW as a leading private client adviser. She is an active member of the Immigration Law Practitioners Association and regularly provides immigration training for HR and recruitment teams and other practitioners.

DESCRIPTION:The Global Business Mobility Routes: What you need to know and don’t need to know\n\n\nLevel: Beginner – Intermediate \nDescription: \nPractitioners will gain practical knowledge of the Global Business Mobility routes. We will cover the most popular and useful routes comprehensively including Senior or Specialist Worker\, Graduate Trainee and UK Expansion Worker. An overview of the Service Supplier and Secondment Worker routes will also be provided. Participants will gain an understanding of what is required at each stage of sponsorship and permission application processes. \nTopics covered will include the following: \n· Applying for the relevant sponsor licence; \n· The requisite links between UK and overseas entities for each route; \n· Information and documentation required at the sponsorship stage; \n· Assessing eligibility of the role and individual\, including salary requirements; \n· Certificates of sponsorship; \n· Applications for permission – requirements and processes; and \n· Potential further applications. \nThis session will not cover ongoing sponsor duties. We will not detail sectors covered by each eligible trade agreement under the Service Supplier route. \nThe aim of this course is to support practitioners in advising on the most popular routes and familiarise practitioners with the basics of all Global Business Mobility routes. \nTutors: Samar Shams\, Changes Immigration Ltd and Joanna Hunt\, Fieldfisher \nSamar Shams is Managing Partner at Changes Immigration. Whether you’re just getting started in your career\, or an expert in your field\, we welcome everyone at our Working Group meetings. \nThis ILPA Refugee Working Group meetings will be held in hybrid format\, hosted remotely on Zoom and in person. \nWhether you plan to attend in person or remotely\, please register in advance of the meeting on this page. \nAfter registering\, you will receive a confirmation email containing information about joining the meeting remotely on Zoom. \nWhere meetings are also hosted in person\, they will take place at Garden Court Chambers\, 57-60 Lincoln’s Inn Fields\, London\, WC2A 3LJ. If you would like to attend in person\, in addition to registering as requested above\, please email legal@ilpa.org.uk as soon as possible and no later than 5pm the day before the Working Group meeting to indicate that you would like to attend in person\, so that your details can be added to the guest list for the purposes of managing numbers and facilitating entry to the building. \nWe look forward to seeing you there. \nIf you haven’t done so already\, we strongly recommend that you sign up to the working group here\, to ensure you don’t miss out on any important information. \nAudience: \nILPA Members. \nPlease note: \n• Meeting attendees will be muted on entry\, so please raise your hand if you wish to speak and then unmute yourself when called upon by a Co-convenor. \n• Please ensure your Zoom name contains your name and organisation name when you join the meeting. \n• ILPA Working Group meetings are recorded. Please bear this in mind when making contributions\, and particularly if you are sharing anything confidential. The recording is for the purpose of the minutes and will not be shared with members. Minutes of Working Group meetings will ordinarily be uploaded to the members-only party of the ILPA website. Please note that the chat will also be recorded and the ILPA Secretariat may get in touch with you after the meeting in relation to contributions you make at the meeting.
