SUMMARY:WEB 3113 Financial Requirements of Appendix FM
DESCRIPTION:It’s all about the money! Together we’ll explore the financial requirements of Appendix FM.\n\n\nLevel: Intermediate \nDescription: \nAt the end of the course participants should fully understand the financial requirements in Appendix FM\, the transitional arrangements in place for those who started on the partner route pre-April 2024\, and the related evidential requirements in Appendix FM-SE\, leaving them equipped to handle a range of applications involving different financial circumstances. \nTopics will cover the requirements for partners and other family members under Appendix FM and Appendix FM-SE\, including: \n• new minimum income requirement and transitional provisions \n• calculating level of income/savings required \n• permitted sources of income \n• specified evidence \n• methods of calculating salaried employment\, self-employment\, non-employment income and cash savings \n• combining sources of income \n• adequate maintenance test \n• other sources of income\, financial support or funds and the differing exceptionality tests \n• case studies \nThe aim of this course is to provide an overview of the financial requirements for partner-based applications for entry clearance and leave to remain made under Appendices FM and FM-SE\, and to explore in detail aspects of those rules. She is the former co-chair of Young Legal Aid Lawyers. During her time as co-chair\, Rachel saw first-hand the effects of working with trauma in the legal profession. She was jointly responsible for the strategic direction of the group and for co-ordinating its campaigning\, promoting social mobility and protecting the interests of junior lawyers who believe in the importance of legal-aided work as a means of achieving social justice. In July 2019 Rachel was awarded the LAPG Special Award for outstanding commitment to access to justice.

The seminar will look at the statutory requirements under the British National Act 1981\, the Home Office guidance on registration\, as well as practical considerations for making applications. It will include an opportunity to participate in case studies of applications under the different routes to registration\, either in groups or led by the tutors. \nThe topics covered will include: \n– Registration applications under sections 1(3)\, 1(4)\, 3(2)\, 3(5)\, 4F and 4G \n– Discretionary applications under section 3(1) \n– Parental consent and proof of paternity \n– Application process and supporting evidence \n*We will not be covering naturalisation or registration applications for adults \nAudience: Practitioners advising families about British nationality options for children or wanting to learn more about this area of law. \nTutors: Emma Cohen\, OTB Legal and Ashley Fleming\, Harper Macleod LLP \nEmma is an associate solicitor at OTB Legal\, a niche immigration law firm in Nottingham. She previously worked in the immigration team at Bindmans LLP for over thirteen years. She covers all areas of immigration\, asylum and nationality law. She has particular interest and experience in complex immigration and nationality cases involving families and children including inter-country adoption and she regularly writes court reports on immigration issues in family cases. Emma qualified as a solicitor in 1995 at Bates\, Wells and Braithwaite where she was later a partner in the immigration department. Although she has spent most of her post qualification experience working in immigration law in private practice Emma has also lectured at Anglia Ruskin University in Cambridge and worked in the voluntary sector. She is a volunteer adviser for Rainbow Migration. \nEmma is a regular trainer for ILPA and had delivered courses on Nationality Applications for Children\, Indefinite Leave to Remain: all you need to know\, Criminality and the Immigration Rules\, Family Law for Immigration Practitioners\, Professional conduct and ethics in immigration cases\, Home Office policy\, concessions & the exercise of discretion outside the rules\, and Discretion – What’s Left? Exploring the use of discretion in immigration and nationality law. She has also spoken at ILPA’s conferences on family migration. \nAshley is a partner at Harper Macleod LLP and has over 15 years’ experience working in the field of immigration. Her caseload covers all aspects of immigration\, asylum and nationality law. \nAshley is a regular trainer for ILPA and has delivered courses on the nationality applications for children\, introductory courses on both immigration and asylum law to MPs’ Caseworkers and Assistants and the Introduction to Immigration Law course for practitioners. \n

No more than 5 people from the same organisation can attend the event. \n\n\nTutors: Joanna Fleck and Rachel Francis\, Claiming Space \nJoanna Fleck is a BACP-registered psychotherapist\, reflective practice facilitator\, and writer. A former solicitor\, she spent over 10 years working in legal aid\, specialising in actions against the state\, inquests and public inquiries. She has an MSc in Psychology with research on secondary traumatic stress in the legal profession. This research and ongoing study informs the work of Claiming Space. She is an experienced freelance trainer and group facilitator as well as a meditation and Mindfulness-Based Cognitive Therapy teacher. \nRachel Francis is a barrister practising in immigration and family law with particular expertise in working with vulnerable clients. She is the former co-chair of Young Legal Aid Lawyers. During her time as co-chair\, Rachel saw first-hand the effects of working with trauma in the legal profession. She was jointly responsible for the strategic direction of the group and for co-ordinating its campaigning\, promoting social mobility and protecting the interests of junior lawyers who believe in the importance of legal-aided work as a means of achieving social justice. In July 2019 Rachel was awarded the LAPG Special Award for outstanding commitment to access to justice.

SUMMARY:ILPA Economic Migration Working Group Meeting
DESCRIPTION:This is a working group meeting for ILPA members.\n\n\nThis is a Working Group meeting for ILPA members. If you are not already an ILPA member\, but would like to attend this meeting\, please contact the ILPA Secretariat (info@ilpa.org.uk). \nDescription: \nILPA working groups are open to all ILPA members. Whether you’re just getting started in your career\, or an expert in your field\, we welcome everyone at our Working Group meetings. \nILPA Economic Migration Working Group meetings will ordinarily be held in hybrid format\, hosted remotely on Zoom and in person. \nWhether you plan to attend in person or remotely\, please register in advance of the meeting on this page. \nAfter registering\, you will receive a confirmation email containing information about joining the meeting remotely on Zoom. \nWhere meetings are also hosted in person\, they will take place at Mayer Brown\, 201 Bishopsgate\, London EC2M 3AF. If you would like to attend in person\, in addition to registering as requested above\, please email legal@ilpa.org.uk as soon as possible and no later than 5pm the day before the Working Group meeting to indicate that you would like to attend in person\, so that your details can be added to the guest list and shared with the relevant colleagues at Mayer Brown for the purposes of managing numbers and facilitating entry to the building. \nWe look forward to seeing you there. \nIf you haven’t done so already\, we strongly recommend that you sign up to the working group here\, to ensure you don’t miss out on any important information. \nChairs: \nThe meeting will be chaired by James Perrott (Mayer Brown International)\, Tom Brett-Young (VWV)\, and Anushka Sinha (Lee and Thompson LLP). \nAudience: \nILPA Members. \nPlease note: \n• Meeting attendees will be muted on entry\, so please raise your hand if you wish to speak and then unmute yourself when called upon by a Co-convenor. \n• Please ensure your Zoom name contains your name and organisation name when you join the meeting. \n• ILPA Working Group meetings are recorded. Please bear this in mind when making contributions\, and particularly if you are sharing anything confidential. The recording is for the purpose of the minutes and will not be shared with members. Minutes of Working Group meetings will ordinarily be uploaded to the members-only party of the ILPA website. Please note that the chat will also be recorded and the ILPA Secretariat may get in touch with you after the meeting in relation to contributions you make at the meeting.
