DESCRIPTION:Practitioners working with children will receive an in-depth look at the ways in which migrant children can register as British citizens.\n\n\nLevel: Beginner- Intermediate \nDescription: \nPractitioners and those working with children will receive an in-depth look at the various ways in which migrant children can register as British citizens. The seminar will look at the statutory requirements under the British National Act 1981\, the Home Office guidance on registration\, including the recent amendments to the guidance for discretionary applications under section 3(1) of the British Nationality Act 1981\, as well as practical considerations for making applications. DESCRIPTION:ILPA’s Updated Statelessness Webinar\n\n\nLevel: Intermediate-Advanced \nDescription: \nThis session is aimed at practitioners who would like a grounding in statelessness issues\, including applying for leave to remain as a stateless person\, routes to acquisition of British citizenship for stateless persons\, and how to evidence statelessness in the context of removal and unlawful detention. \nFollowing this course practitioners and advisors will be better placed to: \n\nAdvise and assist foreign nationals to make applications for leave to remain as stateless persons\nAdvise and assist stateless persons applying for registration as a British citizen\nAdvise and assist on how to provide evidence of statelessness to the required standard in immigration and nationality applications\, and when faced by removal and detention\nAdvise and assist on legal remedies\n\nPlease note that this course will not cover presenting asylum claims but it will include identifying statelessness in the context of asylum claims. \nThis course aims to help busy practitioner to identify where statelessness may be relevant; to advise clients on options\, and to identify a durable solution. \nAudience: Practitioners who work in the field of statelessness and nationality law\, those experienced in other areas of immigration work who already have some knowledge of statelessness and nationality law\, and those seeking a refresher/update course. \nCourse Type: Update on the new rules\, Practical and Overview. \n\n\nTutors: Adrian Berry\, Garden Court Chambers and Judith Carter\, Liverpool Law Clinic \nAdrian Berry is a barrister at Garden Court Chambers and an ILPA Patron. As regards statelessness issues\, he acts and advises in relation to statelessness cases\, including in relation to the 1954 Convention Relating to the Status of Stateless Persons and the 1961 Convention on the Reduction of Statelessness. He works on cases concerning stateless persons in detention\, the regularization of stateless persons\, and the welfare of stateless persons. He has worked with Asylum Aid and the Equal Rights Trust on statelessness issues. He is a co-author of Fransman’s British Nationality Law. \nJudith Carter  has worked on statelessness leave to remain applications since 2013. She is the co-author of the ILPA/Uni of Liverpool Best Practice Guide. She maintains the UK Index on Statelessness for the European Network on Statelessness and has worked as an expert for the UNHCR and Council of Europe. She works at the University of Liverpool Law Clinic as a lecturer and solicitor.

DESCRIPTION:This course will explore the changes introduced by the new Appendix Long Residence to the Immigration Rules from 8 October 2024.\n\n\nLevel: Intermediate-Advanced \nCourse Type: Practical/Overview/Update \nDescription: \nThis course will explore the changes introduced by the new Appendix Long Residence to the Immigration Rules from 8 October 2024. \nWe will examine the scope of each of the requirements and identify\, insofar as possible\, the material differences between the current and previous provisions and their application. We will closely consider the transitional provisions\, including the application of the different absence requirements. \nILPA\, with the tutors’ assistance\, provided comments on earlier iterations of changes to Appendix Long Residence and Appendix Continuous Residence to the Simplification of the Rules Taskforce\, and can walk attendees through the Home Office’s stated policy intention behind several Rule changes. \nWe will specify potential areas of ambiguity in the construction of the new rules and consider how to best approach those in the absence of authoritative guidance by the courts and in light of guidance published by the Home Office for its caseworkers. \nWe will examine practical matters\, case studies\, and attempt to make sense out of what appears to be not simply a cosmetic restructuring\, but a substantive overhaul of the long residence category. \nThis course is intended to bring practitioners up to speed following the introduction of Appendix Long Residence in the Statement of Changes (HC 217). \nThe course will not cover paragraph 39E or provisions in Appendix Continuous Residence that are irrelevant to long residence applications. \nAudience: Immigration practitioners (paralegals\, OISC\, solicitors\, barristers) \n\n\nTutors: Zoe Bantleman\, Barrister and Legal Director at ILPA and Alex Papasotiriou of Richmond Chambers. \nZoe Bantleman is a barrister\, the Legal Director of the Immigration Law Practitioners’ Association (ILPA)\, and an editor of the Journal of Immigration\, Asylum and Nationality Law. \nHer practice as a barrister covered a wide spectrum of advisory work\, drafting and advocacy involving all aspects of UK immigration\, nationality and asylum law. SUMMARY:FREE 3073 International Accountability for Torture
DESCRIPTION:An ILPA Bitesize Webinar delivered in collaboration with REDRESS\, an NGO that pursues legal claims on behalf of survivors of torture.\n\n\nThis event is open to ILPA members only. If you are not already an ILPA member\, but would like to attend this training\, please contact the ILPA Secretariat about membership (info@ilpa.org.uk). \nIn this webinar\, we will introduce participants to international human rights and how ‘torture’ fits into the framework. We will cover: \n· Key international treaties\, \n· Definition of torture\, \n· The fora in which accountability can be sought (including UN mechanisms and regional human rights mechanisms\, the use of human rights sanctions and universal jurisdiction)\, \n· Potential hurdles \n· Some examples of how survivors of torture (who are based in the UK) have used these processes \n· What justice means to survivors \n· What to do if you think you have a case suitable for these mechanisms. \nPlease note the brief introductory nature of the session will not allow detailed discussion of the practical steps required to start a claim/complaint. \nAim of the course: To improve knowledge of practitioners in the A&I sector in relation to routes to accountability at the international level for survivors of torture. \n\n\nTutors: Chris Esdaile\, Senior Legal Advisor and Camila Marin Restrepo\, Communities Officer at REDRESS. \nChris is a Senior Legal Advisor at REDRESS. Prior to joining REDRESS in 2017\, Chris worked at Leigh Day on corporate accountability litigation\, and on claims resulting from ill-treatment by British forces during the Iraq conflict. After working in South Africa on human rights issues in the period before the end of apartheid\, as a solicitor in the UK he undertook housing litigation for vulnerable tenants in Birmingham\, where he was a founding partner of the specialist housing practice\, the Community Law Partnership. Chris served on the International Human Rights Committee of the Law Society from 2000 to 2004. From 2004-2009 he worked as legal advisor at a centre for abused women in northern Chile\, later assuming the role of director of this project. Chris studied law at Birmingham University (LLB) and has an LLM in International Human Rights Law from Queen Mary University of London. \nCamila is a Communities Officer at REDRESS. She specialises in survivor co-creation and supports survivors to participate in advocacy and legal processes. She has worked extensively with survivors of human rights abuses\, including survivors of torture and persecution\, refugees\, and families of disappeared persons. She has previously worked with Human Rights Defenders at risk with Peace Brigades International in Mexico\, with the Grenfell-affected community in London and with grassroots initiatives promoting survivor-led participation during the Colombian peace process. She has an MSc in Social and Cultural Anthropology from UCL and BSc in Economics from Queen Mary\, University of London.

SUMMARY:WEB 3079 Prevention of Illegal Working
DESCRIPTION:Understanding an employer’s obligations under the prevention of illegal working regime.\n\n\nLevel: Basic – Intermediate \nDescription: \nWith the move to digital immigration status and delays to the rollout of eVisas\, there have been some significant changes within the prevention of illegal working framework and to the process that employers need to follow to carry out right to work checks. Supporting businesses to remain compliant with their prevention of illegal working obligations is a key component of a business immigration lawyer’s day to day work and it is important that you are familiar with the requirements and the consequences of failing to carry out right to work checks correctly. \nWith this in mind\, this session will take you through what employers need to know to ensure they remain compliant with their prevention of illegal working obligations. It will cover why right to work checks are important\, the process for carrying out right to work checks\, and the consequences for employers if they fail to do so. It will address the employment law considerations that weigh into decision making in this area and how to manage instances of illegal working and dismissals. It will also touch on how the civil penalty scheme works when instances of illegal working arise. We will also discuss the implications of the phase out of biometric residence permits and of the ongoing rollout of eVisas. \nAudience: \nThis course is designed for immigration and employment practitioners who advise employers on their prevention of illegal working obligations. \n\n\nTutors: Joanna Hunt\, Partner at DAC Beachcroft and Gillian McKearney\, Senior Solicitor at Edgewater Legal.  \nJoanna Hunt is a partner at DAC Beachcroft. She advises on all aspect of immigration law; applications under the Points Based Immigration System and other categories of the Immigration Rules and British nationality law. Her expertise lies with work-based migration and she has a varied client base covering large multi-nationals\, SMEs and private clients. She writes extensively on immigration law issues\, having published articles in numerous media outlets and journals and she is an expert contributor to the Free Movement blog. She is an experienced public speaker and trainer. Joanna is also a member of the Law Society’s Immigration Committee.’ \nGillian McKearney is a Senior Solicitor at Edgewater Legal. She advises on all aspects of immigration and nationality law and has extensive experience including advising on work routes\, business visitors\, compliance and strategy. She advises companies ranging from start-ups to large multinationals including in the technology\, energy\, financial and life sciences sectors as well as private clients. SUMMARY:FREE 3075 Temporary Permission to Stay for Victims of Trafficking
DESCRIPTION:This short course introduces the Appendix Temporary Permission to Stay for Victims of Human Trafficking or Slavery.\n\n\nThis event is open to ILPA members only. If you are not already an ILPA member\, but would like to attend this training\, please contact the ILPA Secretariat about membership (info@ilpa.org.uk). \nThis short course introduces the Appendix Temporary Permission to Stay for Victims of Human Trafficking or Slavery. This appendix to the Immigration Rules replaced the policy on Discretionary Leave for victims of modern slavery as from 30/01/23. We will consider the Immigration Rules and recent changes to the guidance\, their compliance with the Anti-trafficking Convention\, how to prepare a case and potential challenges. \nThis course will not go into other changes introduced by the Nationality and Borders Act in any detail. \nAudience: This course will be useful to all those working with victims of trafficking\, including legal advisors and support workers. \nLevel: Beginner/Intermediate/Advanced \nAim of the course: To provide training on the requirements for applying for leave to remain for victims of trafficking and the reconsideration/appeal/JR remedies. \n\n\nTutors: Claire Physsas\, One Pump Court Chambers and Beth Mullan-Feroze\, ATLEU. \nClaire is a barrister at One Pump Court Chambers. She specialises in Immigration\, Asylum and Public Law. She has extensive experience of representing victims of trafficking in judicial review matters and in appeals before the Immigration and Asylum Chambers. Claire is ranked in Legal 500 2023 as a Leading Junior in Immigration and has been ‘Recommended for trafficking cases’ by Legal 500. She provides training on the legal rights and entitlements of victims of trafficking. Alongside her practice she worked as a training consultant for ATLEU from November 2022 to June 2024. \nBeth is the Solicitor / Legal Training and Partnerships Manager at ATLEU. Beth is a qualified solicitor and has been working with\, advising and assisting asylum seekers and survivors of trafficking since 2010. Beth works on a range of issues directly impacting those who have been survivors of trafficking and is a specialist on trauma informed working.
