SUMMARY:WEB 3008 Nationality Applications for Children (Webinar)
DESCRIPTION:Practitioners working with children will receive an in-depth look at the ways in which migrant children can register as British citizens.\n\n\nL evel: Beginner- Intermediate \nDescription: \nPractitioners and those working with children will receive an in-depth look at the various ways in which migrant children can register as British citizens. The seminar will look at the statutory requirements under the British National Act 1981\, the Home Office guidance on registration\, including the recent amendments to the guidance for discretionary applications under section 3(1) of the British Nationality Act 1981\, as well as practical considerations for making applications. It will include an opportunity to participate in case studies of applications under the different routes to registration\, either in groups or led by the tutors. \nThe topics covered will include: \n– Registration applications under sections 1(3)\, 1(4)\, 3(2)\, 3(5)\, 4F and 4G \n– Discretionary applications under section 3(1) \n– Parental consent and proof of paternity \n– Application process and supporting evidence \n*We will not be covering naturalisation or registration applications for adults \nAudience: Practitioners advising families about British nationality options for children or wanting to learn more about this area of law. \n\n\nTutors: Emma Cohen\, OTB Legal and Ashley Fleming\, Harper Macleod \nEmma is an associate solicitor at OTB Legal. Prior to joining OTB Legal she was an associate solicitor in the immigration department at Bindmans LLP where she had worked for over ten years. She covers all areas of immigration\, asylum and nationality law. She has particular interest and experience in complex immigration and nationality cases involving families and children including inter-country adoption and she regularly writes court reports on immigration issues in family cases. Emma qualified as a solicitor in 1995 at Bates\, Wells and Braithwaite. Although she has spent most of her 25 years post qualification experience working in immigration law in private practice Emma has also lectured at Anglia Ruskin University in Cambridge. She is a volunteer adviser for Rainbow Migration. \nEmma is a regular trainer for ILPA and had delivered courses on Family Law for Immigration Practitioners\, Indefinite Leave to Remain: all you need to know\, Criminality in the Immigration Rules\, Professional conduct and ethics in immigration cases\, Home Office policy\, concessions & the exercise of discretion outside the rules\, and Discretion – What’s Left? Exploring the use of discretion in immigration and nationality law. \nAshley is a senior associate solicitor at Harper Macleod LLP and has over 15 years’ experience working in the field of immigration. Her caseload covers all aspects of immigration\, asylum and nationality law. \nAshley is a regular trainer for ILPA and has delivered courses on the EU Settlement Scheme\, introductory courses on both immigration and asylum law to MPs’ Caseworkers and Assistants and the Introduction to Immigration Law course for practitioners.

SUMMARY:WEB 2113 Expansion Worker: an overview
DESCRIPTION:Aim of the course: to consolidate knowledge of the UK Expansion Worker category\, share practical tips and analyse the route strategically.\n\n\nLevel: Beginner – Intermediate  \nDescription: \nThe UK Expansion category\, targeted at businesses outside the UK which are seeking to expand their presence within the UK\, was introduced on 11 April 2022 (as one of the five new Global Mobility routes) and has replaced the Sole Representative of an Overseas Business category. This session will summarise areas of similarity between the new route and the one it replaces\, key changes and how practitioners can best support their clients in navigating the new category.  \nTopics will include: \n\nStrategic assessment – when to use the Expansion Worker route \nRequirements for businesses seeking to obtain a licence to sponsor on this route\nEligibility criteria for migrant worker\nDocuments required in support of the application \nPractical considerations\nTips on making a successful application \nCase studies \nPeriods of grant and long term planning to remain in the UK\n\nAudience: \nThe session is aimed at practitioners who have a basic knowledge of the category.  \n\n\nT utors: Aisha Choudhry\, Bates Wells and Sacha Wooldridge\, Birketts LLP \nAisha is Senior Associate in the Immigration Department at Bates Wells and specialise in corporate immigration. She primarily deals with skilled worker visas involving sponsor licences\, mergers and acquisitions\, strategy and compliance. She is also experienced with sole representative of overseas business applications. \nPrior to Bates Wells\, Aisha worked at EY. \nAisha is passionate about well-being in the workplace and is a trained Mental Health First Aider. Aisha is a co-founder and co-convenor of the ILPA Well-being Working Group. Aisha has been a trustee of ILPA since 2020. \nSacha is a Partner at Birketts\, specialising in UK immigration and nationality law. Admitted to the roll of solicitors in September 2013 and with almost 10 years’ experience working with some of the world’s largest global businesses and their international employee mobility programmes\, Sacha specialises in supporting business with their employee visa applications\, immigration compliance and global mobility strategy. \nSacha provides practical\, commercial advice that is well integrated with other key considerations including tax\, social security and employment law. Sacha has a wealth of experience supporting businesses from start-ups to FTSE 100s across all sectors including financial and professional services\, engineering\, FMCG\, energy and technology. Sacha provides end-to-end immigration support for business with a deep personal commitment to providing a friendly and personable point of contact with the highest quality service and technical advice – recognising that moving people internationally is both critical for business and can be a challenging time for individuals and their families. Sacha is also able to support business through its key growth milestones – advising on the immigration implications of mergers and acquisitions\, restructuring and TUPE transfers and helping business navigate the latest geopolitical challenges including Brexit and Covid19.

DESCRIPTION:This course will  provide an overview of the legal framework for ILR on the basis of 10 years of continuous lawful residence.\n\n\nL evel: Intermediate \nDescription: \nThe focus of this course will be on providing an overview of the legal framework for indefinite (and limited) leave to remain on the basis of 10 years of continuous lawful residence. The Webinar will cover practical tips in advising on and preparing these applications and appeals. \nCase law developed in the past few years\, such as Juned Ahmed\, Masum Ahmed\, Hoque & Ors and Afzal (in the Court of Appeal and pending a judgment by the Supreme Court) has made continuous lawful residence a difficult area on which to advise. This Webinar will bring the audience up to date on the import of the recent Court of Appeal case law and explain the distinction drawn between previous and current overstaying for applicants and appellants. \nThe effects of section 3C of the Immigration Act 1971\, including when it is engaged and when it has come to an end\, are crucial to understanding whether an applicant or appellant has continuous lawful residence. In the case of Akinola\, the Court of Appeal examined the effect of s.3C in certain specific circumstances\, such as out-of-time appeals and withdrawn and reconsidered decisions. Additionally\, understanding how the exception to overstayers in paragraph 39E can affect whether an applicant can meet the requirements for continuous lawful residence is also important. In Kalsi and in Ali\, the Court of Appeal examined the scope of paragraph 39E. Both of these areas of law will be covered in the Webinar. \nThe Home Office policy guidance document titled ‘Long Residence’ provides for the exercise of discretion where breaks in continuous or in lawful residence occurred due to compelling\, compassionate\, or exceptional circumstances. The Webinar will explore the manner in which the existence of such circumstances can be argued and demonstrated. \nRecent statements of changes to the Immigration Rules introduced changes to the definition of lawful residence for the purposes of long residence applications. Together we’ll explore the financial requirements of Appendix FM.\n\n\nLevel: Intermediate \nDescription: \nAt the end of the course participants should fully understand the financial requirements in Appendix FM and the related evidential requirements in Appendix FM-SE\, and be equipped to handle a range of applications involving different financial circumstances. \nTopics will cover the requirements for partners and other family members under Appendix FM and Appendix FM-SE\, including: \n• calculating level of income/savings required \n• permitted sources of income \n• specified evidence \n• methods of calculating salaried employment\, self-employment\, non-employment income and cash savings \n• combining sources of income \n• adequate maintenance test \n• other sources of income\, financial support or funds and the differing exceptionality tests \n• case studies \nThe aim of this course is to provide an overview of the financial requirements for partner-based applications for entry clearance and leave to remain made under Appendices FM and FM-SE\, and to explore in detail aspects of those rules. Come prepared with a calculator! \nAudience: \nThe session is aimed at those who are already practising in this area\, and will assume working knowledge of the structure of Appendix FM within the immigration rules. \n\n\nTutors: Nath Gbikpi\, Leigh Day and Adam Cotterill\, Solicitor  \nAdam has over 14 years’ experience in UK immigration law. He is recognised as one of the UK’s leading lawyers and has been ranked as a Rising Star by the Legal 500 for the last four consecutive years. His work bridges personal and business immigration\, advising on applications based on family relationships alongside the more commercial and work-based routes. He has built up a particular expertise advising employers and individuals on the implications of Brexit and the EU Settlement Scheme.  Matthew has spoken at events for umbrella organisations and provided commentary for legal resources and the wider media.  He is listed in a number of legal directories\, including Who’s Who Legal\, Chambers and Partners\, and Legal 500.
