DESCRIPTION:We will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences.\n\n\nLevel: Intermediate – Advanced \nCourse Type: Overview \nDescription: \nWe will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences. \nThe high level of recent merger\, acquisition and restructuring activity in the UK means practitioners are frequently being asked to advise on the immigration and right to work aspects of corporate transactions. Where one or more of the entities involved has a sponsor licence\, this will often consist of reviewing the current sponsor licence arrangements\, advising on the appropriate arrangement post-transaction and then taking the necessary steps to ensure that the appropriate entity is able to continue to employ its sponsored workers. This may involve either making a notification to the Home Office or submitting an application for a new licence. If the transaction involves staff transferring between entities\, this can also involve right to work issues. \nPractitioners are also frequently required to understand the types of structures that international companies employ and advise on whether these structures mean that these businesses can transfer their overseas employees to the UK under the Global Business Mobility routes. \nThe course will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences. It will consider the steps that need to be taken when a company that holds a Skilled Worker sponsor licence is involved in a corporate transaction. Finally\, it will look at the right to work issues that arise from corporate transactions. \nTopics: \n• Initial sponsor licence applications\, with a focus on Skilled Worker and Senior/Specialist Worker licences; \n• Adding new UK and overseas group entities to a sponsor licence; \n• Qualifying types of corporate group structures for the Global Business Mobility routes; \n• Recognising and dealing with common change of ownership scenarios; \n• Worked examples of the steps that practitioners should take when notifying the Home Office when a sponsor licence holder is involved in a corporate transaction; and \n• Right to work and due diligence issues which arise as a result of corporate transactions. \nBy the end of this course you will gain an understanding of the requirements relating to qualifying linked entities for the purposes of Global Business Mobility licences\, be able to identify relevant changes to corporate structures as well as understand the appropriate action to be taken in respect of such changes. \nThe course will not cover: \n-Step by step guidance on reporting or submitting change of circumstance requests \n-In-depth guidance on general sponsor licence application requirements and documents \nAudience: This session is aimed at practitioners who have existing knowledge of sponsor licence applications and are looking to broaden their understanding of corporate structures and the steps that need to be taken from an immigration standpoint before\, during and after the completion of a corporate transaction. \n\n\nTutors: Robert Houchill and Kate Harding at Kingsley Napley. \nRobert Houchill has extensive experience of assisting individuals and organisations with their UK immigration and nationality matters. She is an experienced freelance trainer and group facilitator as well as a meditation and Mindfulness-Based Cognitive Therapy teacher. \nRachel Francis is a barrister practising in immigration and family law with particular expertise in working with vulnerable clients. She is the former co-chair of Young Legal Aid Lawyers. During her time as co-chair\, Rachel saw first-hand the effects of working with trauma in the legal profession. She was jointly responsible for the strategic direction of the group and for co-ordinating its campaigning\, promoting social mobility and protecting the interests of junior lawyers who believe in the importance of legal-aided work as a means of achieving social justice. In July 2019 Rachel was awarded the LAPG Special Award for outstanding commitment to access to justice.

SUMMARY:FREE 3075 Temporary Permission to Stay for Victims of Trafficking
DESCRIPTION:This short course introduces the Appendix Temporary Permission to Stay for Victims of Human Trafficking or Slavery.\n\n\nThis event is open to ILPA members only. This appendix to the Immigration Rules replaced the policy on Discretionary Leave for victims of modern slavery as from 30/01/23. We will consider the Immigration Rules and recent changes to the guidance\, their compliance with the Anti-trafficking Convention\, how to prepare a case and potential challenges. \nThis course will not go into other changes introduced by the Nationality and Borders Act in any detail. \nAudience: This course will be useful to all those working with victims of trafficking\, including legal advisors and support workers. \nLevel: Beginner/Intermediate/Advanced \nAim of the course: To provide training on the requirements for applying for leave to remain for victims of trafficking and the reconsideration/appeal/JR remedies. \n\n\nTutors: Claire Physsas\, One Pump Court Chambers and Beth Mullan-Feroze\, ATLEU. \nClaire is a barrister at One Pump Court Chambers. She specialises in Immigration\, Asylum and Public Law. She has extensive experience of representing victims of trafficking in judicial review matters and in appeals before the Immigration and Asylum Chambers. Claire is ranked in Legal 500 2023 as a Leading Junior in Immigration and has been ‘Recommended for trafficking cases’ by Legal 500. She provides training on the legal rights and entitlements of victims of trafficking. DESCRIPTION:Understanding an employer’s obligations under the prevention of illegal working regime.\n\n\nLevel: Basic – Intermediate \nDescription: \nWith the move to digital immigration status and delays to the rollout of eVisas\, there have been some significant changes within the prevention of illegal working framework and to the process that employers need to follow to carry out right to work checks. Supporting businesses to remain compliant with their prevention of illegal working obligations is a key component of a business immigration lawyer’s day to day work and it is important that you are familiar with the requirements and the consequences of failing to carry out right to work checks correctly. \nWith this in mind\, this session will take you through what employers need to know to ensure they remain compliant with their prevention of illegal working obligations. It will cover why right to work checks are important\, the process for carrying out right to work checks\, and the consequences for employers if they fail to do so. It will address the employment law considerations that weigh into decision making in this area and how to manage instances of illegal working and dismissals. It will also touch on how the civil penalty scheme works when instances of illegal working arise. DESCRIPTION:An ILPA Bitesize Webinar delivered in collaboration with REDRESS\, an NGO that pursues legal claims on behalf of survivors of torture.\n\n\nThis event is open to ILPA members only. We will cover: \n· Key international treaties\, \n· Definition of torture\, \n· The fora in which accountability can be sought (including UN mechanisms and regional human rights mechanisms\, the use of human rights sanctions and universal jurisdiction)\, \n· Potential hurdles \n· Some examples of how survivors of torture (who are based in the UK) have used these processes \n· What justice means to survivors \n· What to do if you think you have a case suitable for these mechanisms. \nPlease note the brief introductory nature of the session will not allow detailed discussion of the practical steps required to start a claim/complaint. \nAim of the course: To improve knowledge of practitioners in the A&I sector in relation to routes to accountability at the international level for survivors of torture. \n\n\nTutors: Chris Esdaile\, Senior Legal Advisor and Camila Marin Restrepo\, Communities Officer at REDRESS. \nChris is a Senior Legal Advisor at REDRESS. Prior to joining REDRESS in 2017\, Chris worked at Leigh Day on corporate accountability litigation\, and on claims resulting from ill-treatment by British forces during the Iraq conflict. After working in South Africa on human rights issues in the period before the end of apartheid\, as a solicitor in the UK he undertook housing litigation for vulnerable tenants in Birmingham\, where he was a founding partner of the specialist housing practice\, the Community Law Partnership. Chris served on the International Human Rights Committee of the Law Society from 2000 to 2004. From 2004-2009 he worked as legal advisor at a centre for abused women in northern Chile\, later assuming the role of director of this project. Chris studied law at Birmingham University (LLB) and has an LLM in International Human Rights Law from Queen Mary University of London. \nCamila is a Communities Officer at REDRESS. She specialises in survivor co-creation and supports survivors to participate in advocacy and legal processes. She has worked extensively with survivors of human rights abuses\, including survivors of torture and persecution\, refugees\, and families of disappeared persons. She has previously worked with Human Rights Defenders at risk with Peace Brigades International in Mexico\, with the Grenfell-affected community in London and with grassroots initiatives promoting survivor-led participation during the Colombian peace process. She has an MSc in Social and Cultural Anthropology from UCL and BSc in Economics from Queen Mary\, University of London.

DESCRIPTION:This course will explore the changes introduced by the new Appendix Long Residence to the Immigration Rules from 8 October 2024.\n\n\nLevel: Intermediate-Advanced \nCourse Type: Practical/Overview/Update \nDescription: \nThis course will explore the changes introduced by the new Appendix Long Residence to the Immigration Rules from 8 October 2024. \nWe will examine the scope of each of the requirements and identify\, insofar as possible\, the material differences between the current and previous provisions and their application. We will closely consider the transitional provisions\, including the application of the different absence requirements. \nILPA\, with the tutors’ assistance\, provided comments on earlier iterations of changes to Appendix Long Residence and Appendix Continuous Residence to the Simplification of the Rules Taskforce\, and can walk attendees through the Home Office’s stated policy intention behind several Rule changes. \nWe will specify potential areas of ambiguity in the construction of the new rules and consider how to best approach those in the absence of authoritative guidance by the courts and in light of guidance published by the Home Office for its caseworkers. \nWe will examine practical matters\, case studies\, and attempt to make sense out of what appears to be not simply a cosmetic restructuring\, but a substantive overhaul of the long residence category. \nThis course is intended to bring practitioners up to speed following the introduction of Appendix Long Residence in the Statement of Changes (HC 217). \nThe course will not cover paragraph 39E or provisions in Appendix Continuous Residence that are irrelevant to long residence applications. \nAudience: Immigration practitioners (paralegals\, OISC\, solicitors\, barristers) \n\n\nTutors: Zoe Bantleman\, Barrister and Legal Director at ILPA and Alex Papasotiriou of Richmond Chambers. \nZoe Bantleman is a barrister\, the Legal Director of the Immigration Law Practitioners’ Association (ILPA)\, and an editor of the Journal of Immigration\, Asylum and Nationality Law. \nHer practice as a barrister covered a wide spectrum of advisory work\, drafting and advocacy involving all aspects of UK immigration\, nationality and asylum law. Alex advises and represents clients in appeals and judicial review proceedings in relation to all matters of UK immigration and nationality law and appears regularly before the Immigration and Asylum Chamber of the First-tier and Upper Tribunal. \nAlex recently represented the appellant in the case of Maisiri (EUSS\, Zambrano\, ‘Realistic Prospect’ policy)  UKUT 00235\, where the Upper Tribunal held that the Secretary of State’s guidance on EUSS applications by Zambrano carers has been wrong since 14 December 2022. \nHe authors articles and opinions on immigration\, human rights\, refugee and public law matters. His case notes have been published in ILPA Monthly and the Journal of Immigration\, Asylum and Nationality Law. His latest commentary on Ali v Upper Tribunal (Immigration and Asylum Chamber) & Anor  EWCA Civ 372 appeared on Vol 38.3 of the JIANL. Alex has previously taught ILPA webinars on Long Residence\, section 3C of the Immigration Act 1971\, paragraph 39E of the Immigration Rules and validity of applications.

DESCRIPTION:Employing migrant workers: skilled workers\, sponsorship and alternatives\n\n\nLevel: Basic – Intermediate \nDescription: \nA basic to intermediate level course aimed at those who do not yet feel confident with sponsorship and business immigration. Whether you’re just getting started in your career\, or an expert in your field\, we welcome everyone at our Working Group meetings. \nThis ILPA Refugee Working Group meetings will be held in hybrid format\, hosted remotely on Zoom and in person. \nWhether you plan to attend in person or remotely\, please register in advance of the meeting on this page. \nAfter registering\, you will receive a confirmation email containing information about joining the meeting remotely on Zoom. \nWhere meetings are also hosted in person\, they will take place at Garden Court Chambers\, 57-60 Lincoln’s Inn Fields\, London\, WC2A 3LJ.
