SUMMARY:WEB 3050 Sole and Shared Parental Responsibility: rules and practice
DESCRIPTION:The course will review the rules relating to sole and shared parental responsibility applicable to all areas of immigration law.\n\n\nLevel: Intermediate \nDescription: \nThe course will review the rules relating to sole and shared parental responsibility applicable to all areas of immigration law\, from children of British citizens to dependent of skilled workers\, students etc. The course will also review caselaw relating to the concept of sole responsibility\, and the practical application of the rules. We will also think of alternative options for families who cannot meet the strict Immigration Rules relating to sole responsibility. \nTopics: \n\nThe Rules relating to sole and shared parental responsibility\nCaselaw relating to the concept of sole responsibility\nExamine rule changes and implications in practice\nPreparing applications – practical tips and procedure\nAlternative options to move to the UK when the rules are not met\nCase studies\n\nThe aim of the course is to provide an overview of the theory and practice of the Immigration Rules relating to sole and shared parental responsibility\, highlight the difficulties with those rules\, and think of ways in which families who do not meet the rules can move to the UK. \nAudience: \nThe session is aimed at those who are already practising in this area\, assisting with a broad range of immigration applications including children and dependants. \n\n\nTutors: Nath Gbikpi\, Leigh Day and Andrew Jones\, Wesley Gryk Solicitors LLP \nNath is a solicitor at Leigh Day Solicitors. Her practice covers a wide range of immigration\, asylum and nationality law\, with particular emphasis on human rights applications\, including complex applications outside of the rules; initial asylum and fresh claims; applications on the basis of domestic abuse and transnational marriage abandonment; and applications by children in care and care leavers. \nNath also writes regularly for Free Movement\, including case law updates\, briefings and training courses. Nath co-founded the ILPA Well-being Working Group in 2018 and was a co-convenor until June 2020. She is now a co-convenor of the ILPA Family and Personal Migration Working Group. \nNath delivers ILPA’s ‘It’s all about the money: Financial Requirements of Appendix FM’; ‘Sole Responsibility and the Immigration Rules; and ‘The Phenomenon of Transnational Marriage Abandonment’ trainings. She has been a panellist at various ILPA’s conferences and seminars. \nAndrew is a solicitor at Wesley Gryk Solicitors\, a specialist immigration and nationality practice consistently top-ranked in Legal 500\, Chambers UK and The Times Best Law Firms. His practice covers a wide range of immigration\, asylum and nationality matters\, with a particular specialism in family and private life applications.

DESCRIPTION:We will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences.\n\n\nLevel: Intermediate – Advanced \nCourse Type: Overview \nDescription: \nWe will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences. \nThe high level of recent merger\, acquisition and restructuring activity in the UK means practitioners are frequently being asked to advise on the immigration and right to work aspects of corporate transactions. Where one or more of the entities involved has a sponsor licence\, this will often consist of reviewing the current sponsor licence arrangements\, advising on the appropriate arrangement post-transaction and then taking the necessary steps to ensure that the appropriate entity is able to continue to employ its sponsored workers. This may involve either making a notification to the Home Office or submitting an application for a new licence. If the transaction involves staff transferring between entities\, this can also involve right to work issues. \nPractitioners are also frequently required to have an understanding of the types of structures that international companies employ and advise on whether these structures mean that these businesses can transfer their overseas employees to the UK under the Intra-Company routes (including Global Business Mobility – Senior or Specialist Worker and Graduate Trainee). \nThe course will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences. It will consider the steps that need to be taken when a company that holds a Skilled Worker sponsor licence is involved in a corporate transaction. Finally\, it will look at the right to work issues that arise from corporate transactions. \nTopics: \n• Initial sponsor licence applications\, with a focus on Skilled Worker and Intra-Company routes licences; \n• Adding new UK and overseas group entities to a sponsor licence; \n• Qualifying types of corporate group structures for the Intra-Company routes; \n• Recognising and dealing with common change of ownership scenarios; \n• Worked examples of the steps that practitioners should take when notifying the Home Office when a sponsor licence holder is involved in a corporate transaction; and \n• Right to work and due diligence issues which arise as a result of corporate transactions. \nBy the end of this course you will gain an understanding of the requirements relating to qualifying linked entities for the purposes of senior specialist worker licences\, be able to identify relevant changes to corporate structures as well as understand the appropriate action to be taken in respect of such changes. \nAudience: \nThis session is aimed at practitioners who have existing knowledge of sponsor licence applications and are looking to broaden their understanding of corporate structures and the steps that need to be taken from an immigration standpoint before\, during and after the completion of a corporate transaction. \nPlease note the course will not cover step by step guidance on reporting or submitting change of circumstance requests or in depth guidance on general sponsor licence application requirements and documents. \n\n\nTutors: Robert Houchill and Kate Harding at Kingsley Napley. \nRobert Houchill has extensive experience of assisting individuals and organisations with their UK immigration and nationality matters. Robert’s experience covers all kinds of immigration and nationality applications but with a particular emphasis on corporate immigration matters\, and helping high net worth individuals. \nRobert often helps organisations with sponsor licence applications and advises on immigration compliance issues. She spent over 10 years working in legal aid\, specialising in actions against the state\, inquests and public inquiries. She has an MSc in Psychology with research on secondary traumatic stress in the legal profession. This research and ongoing study informs the work of Claiming Space. She is an experienced freelance trainer and group facilitator as well as a meditation and Mindfulness-Based Cognitive Therapy teacher. \nRachel Francis is a barrister practising in immigration and family law with particular expertise in working with vulnerable clients. She is the former co-chair of Young Legal Aid Lawyers. During her time as co-chair\, Rachel saw first-hand the effects of working with trauma in the legal profession. She was jointly responsible for the strategic direction of the group and for co-ordinating its campaigning\, promoting social mobility and protecting the interests of junior lawyers who believe in the importance of legal-aided work as a means of achieving social justice. In July 2019 Rachel was awarded the LAPG Special Award for outstanding commitment to access to justice.
