The group aims to improve access to the sector to counter the limited diversity among immigration practitioners particularly in senior roles\, to address the systemic racism prevalent in the sector within immigration systems and workplaces\, and to help foster a more welcoming environment for racialised practitioners. \nThe Working Group intends to work on fostering an inclusive culture where discussions on racism can take place and how these could be embedded within the workplace so that issues can be made explicit then addressed rather than remaining unacknowledged. \nThe ILPA Racial Justice and Equality working group is first and foremost a space for our Black and Ethnic Minority members\, as a collective space for thoughts\, frustrations and action. SUMMARY:UK Visa Routes for Religious Workers (Bitesize)
DESCRIPTION:Book tickets now \n\n\nOverview\n\n\n\n\nThis course will provide an overview of the legal framework and different immigration routes that religious workers can use to enter the UK \n\n\n\nLevel: Intermediate \nDescription: \nThe aim of the course is to provide attendees with an understanding of the rules and different routes religious workers can use to come into the UK and to explore the information contained in the Policy Guidance that practitioners should be aware of. Practical guidance on preparing applications under these routes will also be provided\, including tips on meeting the documentary requirements\, which is often an issue for religious workers applying for leave in the UK. \nThe focus of this course will be on providing an overview of the legal framework and different immigration routes that religious workers can use to enter and remain in the UK. \nBrexit had a significant impact on religious organisations who relied on the principle of free movement of people to bring over many of their workers such as Nuns\, Priests\, Pastors and volunteers. With EU nationals arriving from 1 January 2021 now requiring sponsorship\, we have seen a rise in applications under the T2 Minister of Religion and T5 Religious Worker routes contained in the Immigration Rules. To complicate matters\, the Immigration Rules under these routes have also been amended. \nApplications under the Religious Worker routes can be complex as a result of many applicants not possessing the required documentation and the Home Office placing an emphasis on economic work in the UK\, which religious workers\, such as Sisters of a Religious Order\, do not always meet. Many religious workers receive no income and do not have their own bank accounts or any correspondence addressed to them\, by virtue of devoting their lives to their community. Added challenges include documenting the work that the individual will be doing in the UK and ensuring the religious organisation\, who do not always understand the workings of the SMS\, meet their sponsorship duties. The Resident Labour Market Test has also been introduced for Religious Workers which is also causing issues for some religious organisations. \nThis webinar will provide practical advice on overcoming these limitations and run through common scenarios that have come up in practice\, as well as provide an overview of the different routes available depending on the work that the individual is coming into the UK to do. \nAudience: Advisors\, solicitors and barristers intending to advise or represent religious workers on their immigration matters in the UK and prepare applications on their behalf. \n  \n\n\n\n\nTutor: Julie Moktadir\, Head of Immigration at Stone King and ILPA Trustee \nILPA trustee and Head of Immigration at Stone King LLP\, Julie has established a specialised expertise in charitable immigration work\, specifically Tier 2 (Ministers of Religion) and Tier 5 (Religious Workers). \nJulie acts for a huge range of clients in the charity sector including\, Religious Orders\, Congregations\, Diocese\, Religious Charitable Organisations and Churches. She regularly advises on the different routes available to religious workers and completes the entire application process on the workers behalf\, to ensure that religious organisations can benefit from the movement of individuals internationally. Julie is very familiar with the common challenges that applicants under these routes can face and has an 100% success rate on all applications made to date\, despite these hurdles. Julie has spoken at conferences aimed at religious organisations\, is a regular speaker for COREW (Conference of Religious England and Wales) and contributes to publications such as the Church Times highlighting the immigration challenges that such organisations face.

DESCRIPTION:Book tickets now\n\n\n\nOverview\n\n\n\n\nWe will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences. \n\n\n\n\nLevel: Intermediate – Advanced \nCourse Type: Overview \nDescription: \nWe will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences. \nThe high level of recent merger\, acquisition and restructuring activity in the UK means practitioners are frequently being asked to advise on the immigration and right to work aspects of corporate transactions. Where one or more of the entities involved has a sponsor licence\, this will often consist of reviewing the current sponsor licence arrangements\, advising on the appropriate arrangement post-transaction and then taking the necessary steps to ensure that the appropriate entity is able to continue to employ its sponsored workers. This may involve either making a notification to the Home Office or submitting an application for a new licence. If the transaction involves staff transferring between entities\, this can also involve right to work issues. \nPractitioners are also frequently required to have an understanding of the types of structures that international companies employ and advise on whether these structures mean that these businesses can transfer their overseas employees to the UK under the Intra-Company routes (including Global Business Mobility – Senior or Specialist Worker and Graduate Trainee). \nThe course will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences. It will consider the steps that need to be taken when a company that holds a Skilled Worker sponsor licence is involved in a corporate transaction. Finally\, it will look at the right to work issues that arise from corporate transactions. \nTopics: \n• Initial sponsor licence applications\, with a focus on Skilled Worker and Intra-Company routes licences; \n• Adding new UK and overseas group entities to a sponsor licence; \n• Qualifying types of corporate group structures for the Intra-Company routes; \n• Recognising and dealing with common change of ownership scenarios; \n• Worked examples of the steps that practitioners should take when notifying the Home Office when a sponsor licence holder is involved in a corporate transaction; and \n• Right to work and due diligence issues which arise as a result of corporate transactions. \nBy the end of this course you will gain an understanding of the requirements relating to qualifying linked entities for the purposes of senior specialist worker licences\, be able to identify relevant changes to corporate structures as well as understand the appropriate action to be taken in respect of such changes. \nAudience: \nThis session is aimed at practitioners who have existing knowledge of sponsor licence applications and are looking to broaden their understanding of corporate structures and the steps that need to be taken from an immigration standpoint before\, during and after the completion of a corporate transaction. \n  \n\n\n\n\nTutors: Ilda de Sousa\, Partner and Vandana Ruda\, Associate at Kingsley Napley. \nIlda de Sousa is a partner in the immigration team at Kingsley Napley. She is a South African qualified attorney and a British qualified solicitor who joined the firm in January 2010. \nIlda has over ten years of UK corporate immigration law experience\, managing large company clients as well as handling complex matters for individuals\, British nationality applications\, appeals\, judicial reviews and applications under European Law including Brexit related advice. \nIlda also has extensive knowledge and experience in all aspects of the Points Based System\, including assisting employers with their Skilled Worker or Temporary Work sponsor registrations and advising on immigration compliance issues. Equally\, she has extensive experience in advising investors\, entrepreneurs and high-net worth individuals. \nPrior to joining Kingsley Napley LLP\, Ilda was the UK Country Manager for Emigra Europe Limited\, a specialist global immigration consultancy firm\, with service centres on three continents\, providing global immigration services for over 100 different countries. Ilda was responsible for the overall management of the UK office\, including advising large multinational clients in respect of their UK Immigration related matters. \nShe also worked as an Associate at ASG Immigration where she advised on all aspects of business and personal immigration\, with an emphasis on multinational employees\, skilled migrants and applications under European law. \nIlda has spoken on matters of immigration law for several distinguished organisations throughout her career. She has also written several articles on a variety of subjects relating to UK Immigration law. \nShe is recommended as a Thought Leader in the 2023 International Who’s Who of Business Immigration Lawyers\, Chambers and Partners\, and is ranked as a Leading Individual in Legal 500 UK 2023. She has also been recognised in the Citywealth Leaders List 2023.. \nVandana Ruda is an Associate in the immigration team at Kinglsey Napley. \nPrior to joining Kingsley Napley\, Vandana worked at several central London law firms\, specialising in UK immigration and nationality law. DESCRIPTION:Book tickets here \n\n\nLevel: Beginner-Intermediate \nDescription: \nThis training session will cover section 3C of the Immigration Act 1971\, as well as validation\, variation\, and withdrawal of applications. We will focus on practical tips and issues encountered when advising and preparing applications. \nIt is important to know and comply with validity requirements\, given an invalid application will not extend leave under section 3C of the Immigration Act 1971. The effects of section 3C\, including when it is engaged and when it has come to an end\, are crucial to understanding whether an applicant has continuous lawful residence and to ensure that an applicant does not overstay and become subject to hostile environment measures. \nWe will look closely at the exception for overstayers\, in Part Suitability\, SUI 13.1-13.2 (the new paragraph 39E of the Immigration Rules). \nWe will also consider the mechanism for varying and withdrawing applications and the impact on continuity of residence and refunding of application fees. \nTogether\, we will run through common scenarios that the tutors have come across in practice in preparing and advising on applications\, administrative reviews\, and appeals. \nTopics to be covered include: \n● What and where are the validity requirements? \n● What is section 3C and how is it different to SUI 13.1? \n● When is section 3C triggered and when does it continue to extend leave? \n● How do you vary a pending application under Part 1? How do you vary under Appendix EU? \n● Is there a difference in effect between withdrawing and varying? \n● What is the effect of varying or withdrawing an application where leave is extended by section 3C? \n● What conditions apply when section 3C is engaged and an application is pending? \n● When does section 3C come to an end? \n● How does the exception for overstayers apply\, after section 3C has ended? \nAudience: Representatives intending to advise and prepare valid applications\, who must understand the variation and withdrawal process to ensure the continuity of their client’s residence in the UK. This seminar is also helpful for representatives representing in applications and/or appeals where it is relevant to determine whether a person has had their leave extended by section 3C. \n  \n\n\n\n\nTutors: Zoe Bantleman is the former Legal Director of the Immigration Law Practitioners’ Association\, a barrister\, and an editor of the Journal of Immigration\, Asylum and Nationality Law. In her role at ILPA\, she worked closely with the Home Office and practitioners on the evolution of validity and variation requirements in the Immigration Rules. \nHer practice as a barrister covered a wide spectrum of advisory work\, drafting\, and advocacy involving all aspects of UK immigration\, nationality and asylum law. She has extensive experience in complex private and family life applications\, including long residence applications. It aims to cultivate a culture amongst immigration practitioners where well-being is discussed openly and not stigmatized and ensure that all immigration practitioners know where to access help if needed. The group meets every 6 weeks and works collectively to create cultural and systemic change within the sector by facilitating workshops\, training and conferences on the topics of mental health\, well-being and vicarious trauma.
