The group aims to improve access to the sector to counter the limited diversity among immigration practitioners particularly in senior roles\, to address the systemic racism prevalent in the sector within immigration systems and workplaces\, and to help foster a more welcoming environment for racialised practitioners. \nThe Working Group intends to work on fostering an inclusive culture where discussions on racism can take place and how these could be embedded within the workplace so that issues can be made explicit then addressed rather than remaining unacknowledged. \nThe ILPA Racial Justice and Equality working group is first and foremost a space for our Black and Ethnic Minority members\, as a collective space for thoughts\, frustrations and action. SUMMARY:WEB 3012 Sponsor Licences and Compliance: obtaining and keeping a licence
DESCRIPTION:Practitioners and HR specialists will receive an in-depth look at sponsor licences.\n\n\nLevel: Intermediate  \nDescription: \nPractitioners and HR specialists will receive an in-depth look at sponsor licences. This will not only include practical advice on how to obtain a sponsor licence but also how to ensure effective compliance and retain the licence. We will discuss the updated submission process and compliance requirements post the December 2020 changes\, highlighting pitfalls and providing tips. We will advise upon the HR practices necessary to ensure sponsor duties are met and other factors that the Home Office would be looking for at a compliance visit. SUMMARY:WEB 3014 Nationality Applications for Children (Webinar)
DESCRIPTION:Practitioners working with children will receive an in-depth look at the ways in which migrant children can register as British citizens.\n\n\nL evel: Beginner- Intermediate \nDescription: \nPractitioners and those working with children will receive an in-depth look at the various ways in which migrant children can register as British citizens. The seminar will look at the statutory requirements under the British National Act 1981\, the Home Office guidance on registration\, including the recent amendments to the guidance for discretionary applications under section 3(1) of the British Nationality Act 1981\, as well as practical considerations for making applications. It will include an opportunity to participate in case studies of applications under the different routes to registration\, either in groups or led by the tutors. \nThe topics covered will include: \n– Registration applications under sections 1(3)\, 1(4)\, 3(2)\, 3(5)\, 4F and 4G \n– Discretionary applications under section 3(1) \n– Parental consent and proof of paternity \n– Application process and supporting evidence \n*We will not be covering naturalisation or registration applications for adults \nAudience: Practitioners advising families about British nationality options for children or wanting to learn more about this area of law. \n\n\nTutors: Emma Cohen\, OTB Legal and Ashley Fleming\, Harper Macleod \nEmma is an associate solicitor at OTB Legal. SUMMARY:WEB 3016 Settlement: family\, private life and other human rights routes
DESCRIPTION:This course will focus on settlement (indefinite leave to remain) applications in the family\, private life and other human rights routes\n\n\nLevel: Intermediate \nDescription: \nThis course will focus on settlement (indefinite leave to remain) applications in the family\, private life and other human rights routes including long residence and will also cover EUSS\, UK ancestry and BN(O) Hong Kong applications. It will include consideration of general issues such as Life in the UK/English language requirements\, criminality and other general grounds for refusal\, continuity of residence\, qualifying periods and Covid 19 discretions as well as the mechanics of applications\, appeals and maintaining ILR including returning resident applications. \nThe aim of the course is to provide practitioners with a clear overview of the current measures\, policy guidance and any concessions in place to enable them to fully advise and prepare clients who are applying or considering applying for settlement in family\, private life and other human rights routes. \nAudience: \nThe session is aimed at practitioners either with prior knowledge and experience of family\, private life and other human rights applications who are looking to refine their knowledge of this area of practice or who wish to expand their knowledge of areas which they do not routinely work in. \n\n\nTutors: Emma Cohen\, OTB Legal and Meghan Vozila  Penningtons Manches Cooper \nMeghan and Emma’s training for ILPA has been described as “excellent” with delegates valuing the “useful sharing of experiences“. \nEmma is an associate solicitor at OTB Legal\, a niche immigration law firm in Nottingham. DESCRIPTION:Statelessness: 2024 revised immigration rules\, British citizen registration and nexus with refugee/ asylum claims\n\n\nLevel: Basic – Intermediate \nDescription: \nThis session is aimed at practitioners who would like a grounding in statelessness issues\, including applying for leave to remain as a stateless person under the 2024 immigration rules\, routes to acquisition of British citizenship for stateless persons\, and how to evidence statelessness in the context of removal and unlawful detention. \nFollowing this course practitioners and advisors will be better placed to: \n\nAdvise and assist foreign nationals to make applications for leave to remain as stateless persons; or asylum as a stateless person\nAdvise and assist on all aspects of applying for registration as a British citizen\nAdvise and assist on how to evidence statelessness to the required standard in other contexts eg. He has contributed to publications including the HJT Immigration Manual\, the Law Society’s Immigration and Asylum Handbook\, and Butterworth’s Immigration Law Service. He has also trained for ILPA\, lectured for the Law Society\, and moderates immigration exams for the OISC and the Law Society. SUMMARY:WEB 3029 New Appendix Long Residence
DESCRIPTION:This course will explore the changes introduced by the new Appendix Long Residence to the Immigration Rules from 11 April 2024.\n\n\nLevel: Intermediate-Advanced \nCourse Type: Practical/Overview/Update \nDescription: \nThis course will explore the changes introduced by the new Appendix Long Residence to the Immigration Rules from 11 April 2024. \nWe will examine the scope of each of the requirements and identify\, insofar as possible\, the material differences between the current and previous provisions and their application. We will closely consider the transitional provisions\, including the application of the different absence requirements. \nILPA\, with the tutors’ assistance\, provided comments on earlier iterations of changes to Appendix Long Residence and Appendix Continuous Residence to the Simplification of the Rules Taskforce\, and can walk attendees through the Home Office’s stated policy intention behind several Rule changes. \nWe will specify potential areas of ambiguity in the construction of the new rules and consider how to best approach those in the absence of authoritative guidance by the courts and in light of guidance published by the Home Office for its caseworkers. \nWe will examine practical matters\, case studies\, and attempt to make sense out of what appears to be not simply a cosmetic restructuring\, but a substantive overhaul of the long residence category. \nThis course is intended to bring practitioners up to speed following the introduction of Appendix Long Residence in the Statement of Changes (HC 590). \nThe course will not cover paragraph 39E or provisions in Appendix Continuous Residence that are irrelevant to long residence applications. That will be covered in a separate seminar\, scheduled for 13 May 2024. \nAudience: Immigration practitioners (paralegals\, OISC\, solicitors\, barristers) \n\n\nTutors: Zoe Bantleman\, Barrister and Legal Director at ILPA and Alex Papasotiriou of Richmond Chambers. \nZoe Bantleman is a barrister\, the Legal Director of the Immigration Law Practitioners’ Association (ILPA)\, and an editor of the Journal of Immigration\, Asylum and Nationality Law. \nHer practice as a barrister covered a wide spectrum of advisory work\, drafting and advocacy involving all aspects of UK immigration\, nationality and asylum law. She has extensive experience in complex private and family life applications\, including long residence applications. She regularly challenged decisions by preparing appeals for human rights and asylum claims and applications for administrative and judicial review. \nShe frequently writes about changes to the UK’s immigration law system and provides commentary on key cases\, including on Hoque & Ors and Akinola. She is a contributing author to both Practical Law and LexisNexis. Zoe has previously taught ILPA webinars on 10 Years’ Continuous Lawful Residence\, How to Prepare Fresh Asylum and Human Rights Claims\, and Section 3C\, Validation\, Variation and Withdrawal of Applications. \nAlex Papasotiriou is an immigration barrister at Richmond Chambers. Alex advises and represents clients in appeals and judicial review proceedings in relation to all matters of UK immigration and nationality law and appears regularly before the First-tier and Upper Tribunal. \nAlex’s practice includes long residence cases\, human rights challenges involving children\, adult dependent relatives\, and cases with medical or suitability issues. He is also frequently instructed in deprivation of citizenship and deportation appeals\, as well as in public law challenges against refusal or cancellation of leave. \nAlex further advises and assists in complex British nationality matters\, such as historic Commonwealth cases requiring family status tracing\, or cases involving adoption or surrogacy. \nAlex authors articles and opinions on a variety of matters relating to UK immigration and nationality law.
