SUMMARY:WEB 3027 The Global Business Mobility routes: What you need to know
DESCRIPTION:The Global Business Mobility routes: What you need to know and don’t need to know\n\n\nLevel: Beginner – Intermediate \nDescription: \nPractioners will gain practical knowledge of the Global Business Mobility routes. We will cover the most popular and useful routes comprehensively including Senior or Specialist Worker\, Graduate Trainee and UK Expansion Worker. An overview of the Service Supplier and Secondment Worker routes will also be provided. Participants will gain an understanding of what is required at each stage of sponsorship and permission application processes. \nTopics covered will include the following: \n· Applying for the relevant sponsor licence; \n· The requisite links between UK and overseas entities for each route; \n· Information and documentation required at the sponsorship stage; \n· Assessing eligibility of the role and individual\, including salary requirements; \n· Certificates of sponsorship; \n· Applications for permission – requirements and processes; and \n· Potential further applications. \nThis session will not cover ongoing sponsor duties. We will not detail sectors covered by each eligible trade agreement under the Service Supplier route. \nThe aim of this course is to support practitioners in advising on the most popular routes and familiarise practitioners with the basics of all Global Business Mobility routes. \n\n\nTutors: Samar Shams\, Changes Immigration Ltd and Joanna Hunt\, Fieldfisher \nSamar Shams is Managing Partner at Changes Immigration. DESCRIPTION:This is a practical webinar focused on the scope for legal challenge to removals to Rwanda. It will cover: \n· Who is at risk of removal to Rwanda \n· Inadmissibility cases – overview of procedure and grounds for challenge \n· ARE cases – overview of procedure and grounds for challenge \n· Applying for extensions of time to respond \n· Scope of section 4 of the Safety of Rwanda Act \n· Preparing submissions under section 4 and types of claim – in-country risk; medical; onward removal \n· Overview of other issues to consider such as Article 8\, trafficking\, age disputes and detention \n· Remedies including interim relief. \nLevel: Intermediate \nAudience: Experienced immigration practitioners \nCourse Type: Practical (new area) \nAim of the course: To give participants a practical understanding of the legal and policy framework surrounding decisions to remove to Rwanda and the procedure and grounds for challenge. \nThis webinar will not cover the Illegal Migration Act provisions (which are not yet in force) and nor will we look in detail at inadmissibility criteria under the Immigration Rules and the Nationality and Borders Act 2022. \n\n\nTutors: Alison Pickup and Michelle Knorr\, Doughty Street Chambers and Zoe Bantleman\, Legal Director at ILPA. \nAlison is Director of Asylum Aid where she leads an expert team providing legal representation to asylum seekers and refugees. Asylum Aid is part of the Helen Bamber Foundation Group. Before joining Asylum Aid (in November 2021)\, Alison was the Legal Director of the Public Law Project. At PLP\, Alison led its work on the access to justice issues in the New Plan for Immigration and on judicial review reform. In June 2020\, Alison was awarded the Outstanding Employed Barrister in an NGO award by the Employed Barristers Committee of the Bar Council. \nMichelle is regularly instructed in judicial reviews\, First-tier Tribunal and Upper Tribunal asylum and human rights appeals. She has a particular interest in representing clients with mental health problems\, disabilities\, children and victims of trafficking. She has specialist expertise in family reunification claims for children and vulnerable adults. She also advises in private law actions for false imprisonment and human rights act damages claims. \nZoe is the Legal Director of the Immigration Law Practitioners’ Association (ILPA)\, a barrister\, and an editor of the Journal of Immigration\, Asylum and Nationality Law.

DESCRIPTION:Reviewing the protection afforded by Article 8 European Convention on Human Rights in 2024.\n\n\nLevel: Intermediate \nDescription: \nReviewing the protection afforded by Article 8 ECHR in 2024\, in conjunction with a detailed look at the recent changes to the Immigration Rules and recent authorities and policy/statutory changes\, in order to provide practitioners with a practical update on how to prepare their cases relying on family and private life. \nTopics: \n• the new immigration rules – Appendix Private Life and Appendix Settlement Family Life \n• the relationship between Article 8 and the Immigration Rules and the public interest considerations in the NIAA 2002 (as amended); \n• entry clearance applications; \n• ‘insurmountable obstacles’ and family life; \n• best interests of children; \n• dependent relatives and carers; \n• Article 8 and appeals\, including ‘new matters’ \nAudience: The session is aimed at all practitioners who are advising clients on claims relating to their family and private lives. Some familiarity with Article 8 would be useful\, as this is not an introductory course. \n\n\nTutors: Mala Savjani\, Solicitor at Wilson Solicitors for Here for Good and Vijay Jagadesham\, Barrister at Garden Court North Chambers \nMala is a solicitor at Wilson Solicitors LLP for Here for Good. Her practice covers a wide range of immigration\, asylum and nationality law\, with particular emphasis on applications based on partnership\, family and private life; asylum on the basis of sexual identity; and the rights of Europeans and their family members. Mala also volunteers for Waterloo Legal Advice Service and Rainbow Migration and is a volunteer lawyer for the charity “Here for Good”. \nVijay “undertakes a wide range of immigration and asylum work\, most notably on behalf of vulnerable adults and children”(Chambers and Partners\, 2019). Vijay recently returned from his sixth trip to the island of Samos in Greece\, where he provided legal aid to asylum seekers and drafted numerous applications to the European Court of Human Rights in relation to age-disputed unaccompanied minors\, and exceptionally secured “interim measures” against the Greek government in relation to breaches of Article 3 ECHR. \nVijay regularly engages in age assessment challenges and is particularly well placed to do so in light of his experience in immigration and asylum law and civil litigation\, including actions against the police. Vijay also draws on his significant public law expertise\, including two successful challenges in the Supreme Court\, in bringing public law challenges in relation to all levels of decision-making. He also advises on claims for damages\, under the common law and the HRA 1998. He is a contributor to the 9th edition of Macdonald’s Immigration Law and Practice.

Supporting businesses to remain compliant with their prevention of illegal working obligations is a key component of a business immigration lawyer’s day to day work and it is important that you are familiar with the requirements and the consequences of failing to carry out right to work checks correctly. \nWith this in mind\, this session will take you through what employers need to know to ensure they remain compliant with their prevention of illegal working obligations. It will cover why right to work checks are important\, the process for carrying out right to work checks and the consequences for employers if they fail to do so. It will address the employment law considerations that weigh into decision making in this area and how to manage instances of illegal working and dismissals. SUMMARY:WEB 3038 UK Visa Routes for Religious Workers (Bitesize)
DESCRIPTION:This  course will provide an overview of the legal framework and different immigration routes that religious workers can use to enter the UK\n\n\nLevel: Intermediate \nDescription: \nThe aim of the course is to provide attendees with an understanding of the rules and different routes religious workers can use to come into the UK and to explore the information contained in the Policy Guidance that practitioners should be aware of. Practical guidance on preparing applications under these routes will also be provided\, including tips on meeting the documentary requirements\, which is often an issue for religious workers applying for leave in the UK.  \nThe focus of this course will be on providing an overview of the legal framework and different immigration routes that religious workers can use to enter and remain in the UK. \nBrexit had a significant impact on religious organisations who relied on the principle of free movement of people to bring over many of their workers such as Nuns\, Priests\, Pastors and volunteers. With EU nationals arriving from 1 January 2021 now requiring sponsorship\, we have seen a rise in applications under the T2 Minister of Religion and T5 Religious Worker routes contained in the Immigration Rules. To complicate matters\, the Immigration Rules under these routes have also been amended. \nApplications under the Religious Worker routes can be complex as a result of many applicants not possessing the required documentation and the Home Office placing an emphasis on economic work in the UK\, which religious workers\, such as Sisters of a Religious Order\, do not always meet. Many religious workers receive no income and do not have their own bank accounts or any correspondence addressed to them\, by virtue of devoting their lives to their community. Added challenges include documenting the work that the individual will be doing in the UK and ensuring the religious organisation\, who do not always understand the workings of the SMS\, meet their sponsorship duties. The Resident Labour Market Test has also been introduced for Religious Workers which is also causing issues for some religious organisations. \nThis webinar will provide practical advice on overcoming these limitations and run through common scenarios that have come up in practice\, as well as provide an overview of the different routes available depending on the work that the individual is coming into the UK to do. \nAudience: Advisors\, solicitors and barristers intending to advise or represent religious workers on their immigration matters in the UK and prepare applications on their behalf. \n\n\nTutor: Julie Mokatdir\, Head of Immigration at Stone King and ILPA Trustee \nILPA trustee and Head of Immigration at Stone King LLP\, Julie has established a specialised expertise in charitable immigration work\, specifically Tier 2 (Ministers of Religion) and Tier 5 (Religious Workers). \nJulie acts for a huge range of clients in the charity sector including\, Religious Orders\, Congregations\, Diocese\, Religious Charitable Organisations and Churches. She regularly advises on the different routes available to religious workers and completes the entire application process on the workers behalf\, to ensure that religious organisations can benefit from the movement of individuals internationally. Julie is very familiar with the common challenges that applicants under these routes can face and has an 100% success rate on all applications made to date\, despite these hurdles. Julie has spoken at conferences aimed at religious organisations\, is a regular speaker for COREW (Conference of Religious England and Wales) and contributes to publications such as the Church Times highlighting the immigration challenges that such organisations face.

DESCRIPTION:Employing migrant workers: skilled workers\, sponsorship and alternatives\n\n\nLevel: Basic – Intermediate \nDescription: \nA basic to intermediate level course aimed at those who do not yet feel confident with sponsorship and business immigration. Laura is an experienced employment and business immigration lawyer who has practised for nearly two decades. \nShe acts for a wide range of clients from individuals\, SMEs and owner-managed businesses to national and multinational organisations. She is particularly experienced in acting for clients within the recruitment\, manufacturing\, life sciences and technology sectors. \nLaura regularly advises on employer sponsorship\, Skilled Worker visas\, the prevention of illegal working\, the immigration implications of mergers and acquisitions and other global business mobility issues inbound to the UK such as the business visitor rules. Laura often advises on complicated overlapping employment and immigration law issues which arise during recruitment\, during the employment relationship or at the point of termination such as dismissing sponsored employees. \nLaura also delivers in-house training on employment and business immigration law to clients. \nShara has worked in the area of UK immigration with since 2010 and heads up the immigration team within Pinsent Masons UK.
