The seminar will look at the statutory requirements under the British National Act 1981\, the Home Office guidance on registration\, as well as practical considerations for making applications. It will include an opportunity to participate in case studies of applications under the different routes to registration\, either in groups or led by the tutors. \nThe topics covered will include: \n– Registration applications under sections 1(3)\, 1(4)\, 3(2)\, 3(5)\, 4F and 4G \n– Discretionary applications under section 3(1) \n– Parental consent and proof of paternity \n– Application process and supporting evidence \n*We will not be covering naturalisation or registration applications for adults \nAudience: Practitioners advising families about British nationality options for children or wanting to learn more about this area of law. \nTutors: Emma Cohen\, OTB Legal and Ashley Fleming\, Harper Macleod LLP \nEmma is an associate solicitor at OTB Legal\, a niche immigration law firm in Nottingham. She previously worked in the immigration team at Bindmans LLP for over thirteen years. She covers all areas of immigration\, asylum and nationality law. She has particular interest and experience in complex immigration and nationality cases involving families and children including inter-country adoption and she regularly writes court reports on immigration issues in family cases. Emma qualified as a solicitor in 1995 at Bates\, Wells and Braithwaite where she was later a partner in the immigration department. Although she has spent most of her post qualification experience working in immigration law in private practice Emma has also lectured at Anglia Ruskin University in Cambridge and worked in the voluntary sector. She is a volunteer adviser for Rainbow Migration. \nEmma is a regular trainer for ILPA and had delivered courses on Nationality Applications for Children\, Indefinite Leave to Remain: all you need to know\, Criminality and the Immigration Rules\, Family Law for Immigration Practitioners\, Professional conduct and ethics in immigration cases\, Home Office policy\, concessions & the exercise of discretion outside the rules\, and Discretion – What’s Left? Exploring the use of discretion in immigration and nationality law. She has also spoken at ILPA’s conferences on family migration. \nAshley is a partner at Harper Macleod LLP and has over 15 years’ experience working in the field of immigration. Her caseload covers all aspects of immigration\, asylum and nationality law. \nAshley is a regular trainer for ILPA and has delivered courses on the nationality applications for children\, introductory courses on both immigration and asylum law to MPs’ Caseworkers and Assistants and the Introduction to Immigration Law course for practitioners.

The group aims to improve access to the sector to counter the limited diversity among immigration practitioners particularly in senior roles\, to address the systemic racism prevalent in the sector within immigration systems and workplaces\, and to help foster a more welcoming environment for racialised practitioners. \nThe Working Group intends to work on fostering an inclusive culture where discussions on racism can take place and how these could be embedded within the workplace so that issues can be made explicit then addressed rather than remaining unacknowledged. \nThe ILPA Racial Justice and Equality working group is first and foremost a space for our Black and Ethnic Minority members\, as a collective space for thoughts\, frustrations and action. It aims to cultivate a culture amongst immigration practitioners where well-being is discussed openly and not stigmatized and ensure that all immigration practitioners know where to access help if needed. The group meets every 6 weeks and works collectively to create cultural and systemic change within the sector by facilitating workshops\, training and conferences on the topics of mental health\, well-being and vicarious trauma.
