Vijay recently returned from his sixth trip to the island of Samos in Greece\, where he provided legal aid to asylum seekers and drafted numerous applications to the European Court of Human Rights in relation to age-disputed unaccompanied minors\, and exceptionally secured “interim measures” against the Greek government in relation to breaches of Article 3 ECHR.  \nVijay regularly engages in age assessment challenges and is particularly well placed to do so in light of his experience in immigration and asylum law and civil litigation\, including actions against the police. Vijay also draws on his significant public law expertise\, including two successful challenges in the Supreme Court\, in bringing public law challenges in relation to all levels of decision-making. He also advises on claims for damages\, under the common law and the HRA 1998. He is a contributor to the 9th edition of Macdonald’s Immigration Law and Practice.

The course includes discussion of relevant changes made by the Nationality and Borders Act 2022. SUMMARY:FREE 2102 The Illegal Migration Act 2023: Entry\, Settlement and Citizenship
DESCRIPTION:This course will look at ss30-37 Illegal Migration act 2023\, which have been in force since 20 July 2023.\n\n\nLevel: Intermediate.  \nAudience: Participants will be experienced immigration advisers with at least a basic understanding of the structure of the IMA and ideally have attended or watched the overview session on 1st November.  \nTopics:  \nThis course will look at ss30-37 Illegal Migration act 2023\, which have been in force since 20 July 2023 and apply to those who arrived in the UK on or after 7 March 2023. The new exclusions from leave to enter or remain\, settlement and citizenship will be covered\, along with the exceptions. Participants will also have the opportunity to discuss what practically can be done to advise and assist those affected by these provisions before the removal duty in s2 IMA 2023 is brought into force.  \nAim of the course: To enable participants to advise clients affected by ss30-37 IMA 2023 on how these affect their entitlement to leave to enter or remain  \n\n\nTutor: Alison Pickup\, Director\, Asylum Aid and Kat Hacker\, Director of Legal Protection\, Helen Bramber Foundation. \nAlison is Director of Asylum Aid where she leads an expert team providing legal representation to asylum seekers and refugees. Asylum Aid is part of the Helen Bamber Foundation Group. Before joining Asylum Aid (in November 2021)\, Alison was the Legal Director of the Public Law Project. At PLP\, Alison led its work on the access to justice issues in the New Plan for Immigration and on judicial review reform. In June 2020\, Alison was awarded the Outstanding Employed Barrister in an NGO award by the Employed Barristers Committee of the Bar Council.   \nKat is the Director of the Legal Protection team at the Helen Bramber Foundation. She has spent over a decade working as a lawyer in the immigration and human rights field representing survivors of trafficking\, tortuew and conducting high-profile complex asylum claims before moving into the NGO sector. DESCRIPTION:Employing migrant workers: skilled workers\, sponsorship and alternatives\n\n\nLevel: Basic – Intermediate \nDescription: \nA basic to intermediate level course aimed at those who do not yet feel confident with sponsorship and business immigration. SUMMARY:FREE 2101 The Illegal Migration Act 2023: An Overview
DESCRIPTION:The focus of this course will be on providing an overview of the Illegal Migration Act 2023.\n\n\nILPA is acutely aware of the need to bring legal practitioners and other individuals in frontline roles assisting and working with migrants\, up to speed on the Illegal Migration Act 2023.  \nLevels: Intermediate – some familiarity with the immigration and asylum system\, and a keen interest to understand how the Illegal Migration Act 2023 will impact it. \nAudience:  \n\nAdvisors\, caseworkers\, solicitors and barristers intending to advise and represent individuals affected by the Illegal Migration Act 2023 \nFrontline organisations\, local authorities\, and social workers wishing to understand how the Act may affect individuals they assist and with whom they interact\n\nTopics this course will briefly cover:  \n\nthe purpose of the Act; \nthe cohorts of individuals that are likely to be affected by the Act;\nprovisions that have been commenced;\nprovisions that may retrospectively affect individuals\, if they are commenced\, and upon which individuals should be advised;\nthe new duty and power to make arrangements for removal; \nthe inadmissibility regime the Act introduces\, explaining how the provisions differ from the current inadmissibility regime brought into force by the Nationality and Borders Act 2022; \nsome circumstances in which individuals should be signposted to a legal representative for assistance;\napplications and claims that can be made by people affected by the Act\, including human rights claims\, applications for discretionary leave and suspensive claims and appeals;\nnew detention powers\, principles\, and methods of seeking release;\nprovisions affecting protection for victims and survivors of modern slavery and human trafficking\, including support and recovery;\nhow legal aid advice and representation is impacted by this Act;\nother likely practical implications of the Act; and \nreflection and discussion\, looking forward to the future under this Act. \n\nThe course will signpost to other parts of the Illegal Migration Act 2023 including provisions pertaining to:  \n\naccommodation of unaccompanied children; \nage assessment; \nelectronic devices; \n“safe and legal” routes. \n\nAim of the course  \n\nTo provide attendees with a brief overview of the Illegal Migration Act 2023;\nTo provide very initial guidance to understand when an individual may need legal advice;\nTo help individuals understand how their work\, and the migrants they assist\, may be impacted by the Act so that they may offer the best possible support to people impacted by the Bill.\n\n\n\nTutor: Zoe Bantleman\, Legal Director\, ILPA. \nZoe Bantleman is a barrister\, the Legal Director of the Immigration Law Practitioners’ Association (ILPA)\, and an editor of the Journal of Immigration\, Asylum and Nationality Law.Working closely with ILPA members\, colleagues in the third sector\, and Parliamentarians\, she led ILPA’s work on the Illegal Migration Bill\, drafting amendments that were tabled and debated throughout its passage. ILPA produced a number of briefings\, particularly joint briefings that brought together a range of civil society actors to advocate for improvements to the Bill\, before the Illegal Migration Bill received royal assent. Zoe was a panelist in the GLA Emergency Summit on the Illegal Migration Bill on 25 May 2023. She sits on the Greater London Authority’s Illegal Migration Act Advisory Board. Zoe has discussed the Illegal Migration Act 2023 with the Home Office in stakeholder meetings\, chaired Strategic Legal Advice Committee Meetings on the Act\, responded to the Ministry of Justice’s consultation on ‘Legal Aid Fees in the Illegal Migration Bill’\, presented on the Act at Public Policy Exchange’s webinar ‘Asylum Seekers & Refugees in the UK: Seeking a More Effective\, Supportive & Humane Migration System’ and at the Refugee and Migrant Children’s Consortium’s Conference ‘The Illegal Migration Act\, local authorities and separated children’. \nHer intention\, in providing this training\, is to share the knowledge she has gained through her work on the Act with the widest possible audience.

No more than 5 people from the same organisation can attend the event.  \n\n\nTutors: \nJoanna Fleck is a reflective practice facilitator\, trainee psychotherapist\, and writer. She spent over 10 years working in legal aid\, specialising in actions against the state\, inquests and public inquiries. She has an MSc in Psychology with research on secondary traumatic stress in the legal profession. This research and ongoing study informs the work of Claiming Space. She is an experienced freelance trainer and group facilitator as well as a meditation and Mindfulness-Based Cognitive Therapy teacher. \nRachel Francis is a barrister practising in immigration and family law with particular expertise in working with vulnerable clients. She is the former co-chair of Young Legal Aid Lawyers. During her time as co-chair\, Rachel saw first-hand the effects of working with trauma in the legal profession. She was jointly responsible for the strategic direction of the group and for co-ordinating its campaigning\, promoting social mobility and protecting the interests of junior lawyers who believe in the importance of legal-aided work as a means of achieving social justice. In July 2019 Rachel was awarded the LAPG Special Award for outstanding commitment to access to justice.

SUMMARY:FREE 1245 Transnational Marriage Abandonment (Members' Online Training)
DESCRIPTION:This webinar will look at the phenomenon of transnational marriage abandonment & how lawyers can assist stranded spouses to return to the UK\n\n\nThis event is open to ILPA members only. If you are not already an ILPA member\, but would like to attend this training\, please contact the ILPA Secretariat about membership (info@ilpa.org.uk). \nThe webinar will look at the phenomenon of transnational marriage abandonment\, a form of domestic abuse which involves migrant women being deliberately stranded abroad\, and how immigration lawyers can assist stranded spouses to return to the UK.  \nTopics: \n1)    The phenomenon of transnational marriage abandonment: what is it and what common experiences are reported by stranded spouses \n2)    Litigation relating to the phenomenon of transnational marriage abandonment: what has been done in family law and immigration law\, including the recent case of AM v SSHD \n3)    Assisting victims of transnational marriage abandonment to return to the UK: theory and practice    \nThe aim of this course is to raise awareness regarding the phenomenon of transnational abandonment; discuss the ways of assisting victims with their immigration matters; and share experiences with assisting stranded spouses to return to the UK.  \n\n\nLevel: Beginner – Intermediate  \nAudience: Immigration law practitioners and others working with migrant victims of domestic abuse. \nTutors:  Pragna Patel\, Southall Black Sisters and Nath Gbikpi\, Leigh Day  \nPragna is a founding member of the Southall Black Sisters (SBS) and Women Against Fundamentalism. She worked as a co-ordinator and senior case worker for SBS from 1982 to 1993 when she left to train as a solicitor. In 2009 she returned to SBS as its Director. She has been centrally involved in some of SBS’ most important cases and campaigns around domestic violence\, immigration and religious fundamentalism. She has also written extensively on race\, gender and religion. \nPragna and her colleagues at SBS have been leading campaigns to raise awareness of transnational marriage abandonment and to reform family and immigration law\, policy and practice to address the needs of survivors. They have trained family law judges\, worked with the previous President of the Family Division and have brought together immigration law practitioners  to form a working group to work with the Home Office with a view to reforming immigration law.  \nNath is a solicitor at Leigh Day Solicitors. Her practice covers a wide range of immigration\, asylum and nationality law\, with particular emphasis on human rights applications\, including complex applications outside of the rules; initial asylum and fresh claims; applications on the basis of domestic abuse and transnational marriage abandonment; and applications by children in care and care leavers.  \nNath also writes regularly for Free Movement\, including case law updates\, briefings and training courses. \nNath co-founded the ILPA Well-being Working Group in 2018 and was a co-convenor until June 2020. She is now a co-convenor of the ILPA Family and Personal Migration Working Group. \nNath delivers ILPA’s ‘It’s all about the money: Financial Requirements of Appendix FM’; ‘Sole Responsibility and the Immigration Rules; and “I can’t afford immigration fees” Fee Waivers trainings. She has been a panellist at various ILPA’s conferences and seminars.
