The group aims to improve access to the sector to counter the limited diversity among immigration practitioners particularly in senior roles\, to address the systemic racism prevalent in the sector within immigration systems and workplaces\, and to help foster a more welcoming environment for racialised practitioners. \nThe Working Group intends to work on fostering an inclusive culture where discussions on racism can take place and how these could be embedded within the workplace so that issues can be made explicit then addressed rather than remaining unacknowledged. \nThe ILPA Racial Justice and Equality working group is first and foremost a space for our Black and Ethnic Minority members\, as a collective space for thoughts\, frustrations and action. SUMMARY:WEB 3036 Employing Migrant Workers: skilled workers and sponsorship
DESCRIPTION:Employing migrant workers: skilled workers\, sponsorship and alternatives\n\n\nLevel: Basic – Intermediate \nDescription: \nA basic to intermediate level course aimed at those who do not yet feel confident with sponsorship and business immigration. We will take a closer look at the requirements for employers and workers. \nTopics: \n• Skilled Worker and Global Business Mobility sponsorship\, and the requirements for employers and workers; \n• specific issues such as new overseas hires\, salary points scoring\, and applications to the Home Office (eg priority for Defined CoS allocations); \n• the impact of the changes to the eligibility criteria for minimum salary levels for newly sponsored and extending staff\, and; \n• alternative immigration routes for those avoiding the sponsorship scheme. \nThe aim of the course is to expand and develop knowledge of business immigration law. We will demystify the sponsorship system and equip attendees to speak with confidence and precision on this tricky subject. \nAudience: \nThis course is suited to all immigration practitioners and HR personnel for UK companies wishing to sponsor migrant workers. \nPlease note this course will not cover the health and care visa or the specific rules relating to health and education sector roles. \n\n\nTutors: Laura Darnley\, Partner at Ward Hadaway and Shara Pledger\, Senior Associate at Pinsent Masons \nLaura is a Partner at Ward Hadaway. Laura is an experienced employment and business immigration lawyer who has practised for nearly two decades. \nShe acts for a wide range of clients from individuals\, SMEs and owner-managed businesses to national and multinational organisations. She is particularly experienced in acting for clients within the recruitment\, manufacturing\, life sciences and technology sectors. \nLaura regularly advises on employer sponsorship\, Skilled Worker visas\, the prevention of illegal working\, the immigration implications of mergers and acquisitions and other global business mobility issues inbound to the UK such as the business visitor rules. Laura often advises on complicated overlapping employment and immigration law issues which arise during recruitment\, during the employment relationship or at the point of termination such as dismissing sponsored employees. \nLaura also delivers in-house training on employment and business immigration law to clients. \nShara has worked in the area of UK immigration with since 2010 and heads up the immigration team within Pinsent Masons UK. She handles sponsor licensing applications for employers as well as other complex Points Based System issues. Shara has comprehensive experience with applications for entrepreneurs/innovators and investors\, and with assisting highly skilled migrants seeking endorsements as ‘Global Talent’. \nShara is a co-convener of the ILPA North West working group. \nShara delivers ILPA’s ‘Introduction to Business Immigration Law’ and ‘Employing Migrant Workers: Tier 2\, sponsorship & alternatives’ training.

Together we’ll explore the financial requirements of Appendix FM.\n\n\nLevel: Intermediate \nDescription: \nAt the end of the course participants should fully understand the new financial requirements in Appendix FM\, the transitional arrangements in place for those who started on the partner route pre-April 2024\, and the related evidential requirements in Appendix FM-SE\, leaving them equipped to handle a range of applications involving different financial circumstances. \nTopics will cover the requirements for partners and other family members under Appendix FM and Appendix FM-SE\, including: \n\nnew minimum income requirement and transitional provisions\ncalculating level of income/savings required\npermitted sources of income\nspecified evidence\nmethods of calculating salaried employment\, self-employment\, non-employment income and cash savings\ncombining sources of income\nadequate maintenance test\nother sources of income\, financial support or funds and the differing exceptionality tests\ncase studies\n\nThe aim of this course is to provide an overview of the financial requirements for partner-based applications for entry clearance and leave to remain made under Appendices FM and FM-SE\, and to explore in detail aspects of those rules.
