SUMMARY:WEB 3080 ILPA Student Sponsors Conference (In-person)
DESCRIPTION:We invite you to attend ILPA’s first Student Sponsors Conference\, hosted as a hybrid event. This all day conference will take place in person at Friends House in London and online via Zoom. The conference\, created by education immigration law experts Tom Brett Young\, Anna Blackden and Nichola Carter\, will examine the Immigration Rules and Home Office Policy Guidance relating to the sponsorship of international students in the UK. The conference will be aimed principally at student sponsorship in independent schools\, colleges and pathway providers. However\, those working at or advising higher education providers holding a student sponsor licence (and who recruit from pathway providers) would also find the content useful. SUMMARY:WEB 3085 Financial Requirements of Appendix FM
DESCRIPTION:It’s all about the money! Together we’ll explore the financial requirements of Appendix FM.\n\n\nLevel: Intermediate \nDescription: \nAt the end of the course participants should fully understand the financial requirements in Appendix FM\, the transitional arrangements in place for those who started on the partner route pre-April 2024\, and the related evidential requirements in Appendix FM-SE\, leaving them equipped to handle a range of applications involving different financial circumstances. \nTopics will cover the requirements for partners and other family members under Appendix FM and Appendix FM-SE\, including: \n• new minimum income requirement and transitional provisions \n• calculating level of income/savings required \n• permitted sources of income \n• specified evidence \n• methods of calculating salaried employment\, self-employment\, non-employment income and cash savings \n• combining sources of income \n• adequate maintenance test \n• other sources of income\, financial support or funds and the differing exceptionality tests \n• case studies \nThe aim of this course is to provide an overview of the financial requirements for partner-based applications for entry clearance and leave to remain made under Appendices FM and FM-SE\, and to explore in detail aspects of those rules. It will include consideration of general issues such as Life in the UK/English language requirements\, criminality and other general grounds for refusal\, continuity of residence\, qualifying periods and Covid 19 discretions as well as the mechanics of applications\, appeals and maintaining ILR including returning resident applications. \nThe aim of the course is to provide practitioners with a clear overview of the current measures\, policy guidance and any concessions in place to enable them to fully advise and prepare clients who are applying or considering applying for settlement in family\, private life and other human rights routes. \nAudience: \nThe session is aimed at practitioners either with prior knowledge and experience of family\, private life and other human rights applications who are looking to refine their knowledge of this area of practice or who wish to expand their knowledge of areas which they do not routinely work in. \n\n\nTutors: Emma Cohen\, OTB Legal and Meghan Vozila Penningtons Manches Cooper \nMeghan and Emma’s training for ILPA has been described as “excellent” with delegates valuing the “useful sharing of experiences“. \nEmma is an associate solicitor at OTB Legal\, a niche immigration law firm in Nottingham. We will cover the most popular and useful routes comprehensively including Senior or Specialist Worker\, Graduate Trainee and UK Expansion Worker. SUMMARY:FREE 3096 Claiming Asylum and Re-trafficking
DESCRIPTION:We will look at claiming asylum for survivors of human trafficking and modern slavery on the grounds of a risk of re-trafficking.\n\n\nIn this webinar we will look at claiming asylum for survivors of human trafficking and modern slavery on the grounds of a risk of re-trafficking. We will introduce evidence relating to the risks of re-trafficking for migrant domestic workers who return to the Philippines as their country of origin. \nThis webinar will equip you with practical knowledge about how to successfully claim asylum (including at appeal stage) for clients on the grounds of a risk of re-trafficking if they were removed from the UK. You will develop more detailed understanding of migrant domestic workers’ experiences of trafficking\, and of claiming asylum\, and of the role of expert witnesses. While these cases are usually unsuccessful at the initial asylum stage\, Hackney Law Centre have had consistent success at appeal stage. Beya will discuss\, using case studies\, how to run a successful protection appeal for this cohort of clients\, including: \n\nRisk of re-trafficking as a ground for asylum\n\n\nArticles 3 and 4 and Humanitarian Protection\n\nProf. John Sidel is a specialist on Philippine and Indonesian history\, politics\, and society. He has written many expert reports in asylum cases involving Filipina and Indonesian victims of human trafficking in the UK and will discuss: \n\nRecurring patterns among the victims of trafficking\n\n\nRecurring patterns in Home Office reasons for refusal\n\n\nRecurring challenges in writing the expert reports\n\nMimi Jalmasco will reflect on her experience as a migrant domestic worker claiming asylum as a survivor of trafficking.

DESCRIPTION:Course aim: To understand how late applications qualify to the EU Settlement Scheme\, challenges\, associated rights and remedies.\n\n\nLevel: Intermediate-Advanced \nDescription: \nThe deadline for applications to the EU Settlement Scheme for the majority of people was 30 June 2021. However\, people can make late applications if there are “reasonable grounds” to do so. Despite the deadline being nearly four years ago\, people are still applying to the EU Settlement Scheme. \nWhat is the latest data on EU Settlement Scheme applications and outcomes? \nWhat are the deadlines? \nTo appeal late and/or apply late? \nWhat does “reasonable grounds” mean? \nWhat is the difference when it comes to Joining Family Members? \nHow are applications being decided by the Home Office? \nWhat is current “best” practice? \nWhat are the rights of people who have late applications submitted to the Home Office? \nHow does article 18 of the Withdrawal Agreement work in the context of late applications to the EU Settlement Scheme? \nWhat are the remedies? \nAudience: Practitioners working with EU Settlement Scheme case who are supporting clients with late applications (IAA level 2\, solicitors and barristers). \nType of Course: Practical\, strategic and providing a latest update. \nTutors: Eva Doerr\, Garden Court Chambers and Luke Piper\, Work Rights Centre. \nEva is a barrister at Garden Court Chambers.
