DESCRIPTION:This course will better enable practitioners to advise clients on all aspects of naturalisation as a British citizen.\n\n\nLevel: Intermediate – Advanced \nDescription: \nThis course will enable practitioners to advise and assist foreign nationals on all aspects of securing naturalisation as a British citizen for adults\, as well as registration for their families/children. This course also includes all relevant up-dates made by the Nationality and Borders Act 2022. \nFollowing this course practitioners and advisors will be better placed to: \n\nAdvise and assist foreign nationals and their family members on the criteria for naturalisation as a British citizen and on associated applications for registration\nAdvise and assist on all aspects of applying for naturalisation as a British citizen\, including residence\, absences\, good character\, and future intentions and on associated applications for registration\n\nAudience: \nThis course is designed for practitioners who work in the field of Nationality law\, those experienced in other areas of immigration work and who already have some knowledge of Nationality law\, and those seeking a refresher/update course. \n\n\nTutors: Adrian Berry\, Garden Court Chambers and Ilda de Sousa\, Kingsley Napley LLP \nAdrian Berry is a barrister at Garden Court Chambers. He has an extensive practice in British nationality law\, both in historic Commonwealth-based claims and in contemporary issues concerning the automatic acquisition of citizenship\, naturalisation and registration\, as well as deprivation and loss of British nationality. \nHe advises on claims to be a British citizen\, British Overseas citizen (BOC)\, British overseas territories citizen (BOTC)\, British National (Overseas) (BN(O))\, British subject (BS)\, or British Protected Person (BPP). \nAdrian served as the Chair of the ILPA Committee of Trustees from 2014-2020 and was appointed as ILPA Patron in 2021.  \nIlda de Sousa is a partner in the immigration team at Kingsley Napley. She is a South African qualified attorney and a British qualified solicitor who joined the firm in January 2010. \nIlda has more than ten years of UK corporate immigration law experience\, managing large company clients as well as handling complex matters for individuals\, British nationality applications\, appeals\, judicial reviews and applications under European Law including Brexit related advice. \nIlda also has extensive knowledge and experience in all aspects of the Points Based System\, including assisting employers with their Skilled Worker or Temporary Work sponsor registrations and advising on immigration compliance issues. Equally\, she has extensive experience in advising investors\, entrepreneurs and high-net worth individuals. \nPrior to joining Kingsley Napley LLP\, Ilda was the UK Country Manager for Emigra Europe Limited\, a specialist global immigration consultancy firm\, with service centres on three continents\, providing global immigration services for over 100 different countries. Ilda was responsible for the overall management of the UK office\, including advising large multinational clients in respect of their UK Immigration related matters. \nShe also worked as an Associate at ASG Immigration where she advised on all aspects of business and personal immigration\, with an emphasis on multinational employees\, skilled migrants and applications under European law. \nIlda has spoken on matters of immigration law for several distinguished organisations throughout her career. She spent over 10 years working in legal aid\, specialising in actions against the state\, inquests and public inquiries. She has an MSc in Psychology with research on secondary traumatic stress in the legal profession. This research and ongoing study informs the work of Claiming Space. She is an experienced freelance trainer and group facilitator as well as a meditation and Mindfulness-Based Cognitive Therapy teacher. \nRachel Francis is a barrister practising in immigration and family law with particular expertise in working with vulnerable clients. She is the former co-chair of Young Legal Aid Lawyers. During her time as co-chair\, Rachel saw first-hand the effects of working with trauma in the legal profession. She was jointly responsible for the strategic direction of the group and for co-ordinating its campaigning\, promoting social mobility and protecting the interests of junior lawyers who believe in the importance of legal-aided work as a means of achieving social justice. In July 2019 Rachel was awarded the LAPG Special Award for outstanding commitment to access to justice.

SUMMARY:FREE 1245 Transnational Marriage Abandonment (Members' Online Training)
DESCRIPTION:This webinar will look at the phenomenon of transnational marriage abandonment & how lawyers can assist stranded spouses to return to the UK\n\n\nThis event is open to ILPA members only. If you are not already an ILPA member\, but would like to attend this training\, please contact the ILPA Secretariat about membership (info@ilpa.org.uk). \nThe webinar will look at the phenomenon of transnational marriage abandonment\, a form of domestic abuse which involves migrant women being deliberately stranded abroad\, and how immigration lawyers can assist stranded spouses to return to the UK.  \nTopics: \n1)    The phenomenon of transnational marriage abandonment: what is it and what common experiences are reported by stranded spouses \n2)    Litigation relating to the phenomenon of transnational marriage abandonment: what has been done in family law and immigration law\, including the recent case of AM v SSHD \n3)    Assisting victims of transnational marriage abandonment to return to the UK: theory and practice    \nThe aim of this course is to raise awareness regarding the phenomenon of transnational abandonment; discuss the ways of assisting victims with their immigration matters; and share experiences with assisting stranded spouses to return to the UK.  \n\n\nLevel: Beginner – Intermediate  \nAudience: Immigration law practitioners and others working with migrant victims of domestic abuse. \nTutors:  Pragna Patel\, Southall Black Sisters and Nath Gbikpi\, Leigh Day  \nPragna is a founding member of the Southall Black Sisters (SBS) and Women Against Fundamentalism. She worked as a co-ordinator and senior case worker for SBS from 1982 to 1993 when she left to train as a solicitor. In 2009 she returned to SBS as its Director. She has been centrally involved in some of SBS’ most important cases and campaigns around domestic violence\, immigration and religious fundamentalism. She has also written extensively on race\, gender and religion. \nPragna and her colleagues at SBS have been leading campaigns to raise awareness of transnational marriage abandonment and to reform family and immigration law\, policy and practice to address the needs of survivors. They have trained family law judges\, worked with the previous President of the Family Division and have brought together immigration law practitioners  to form a working group to work with the Home Office with a view to reforming immigration law.  \nNath is a solicitor at Leigh Day Solicitors. Her practice covers a wide range of immigration\, asylum and nationality law\, with particular emphasis on human rights applications\, including complex applications outside of the rules; initial asylum and fresh claims; applications on the basis of domestic abuse and transnational marriage abandonment; and applications by children in care and care leavers.  \nNath also writes regularly for Free Movement\, including case law updates\, briefings and training courses. \nNath co-founded the ILPA Well-being Working Group in 2018 and was a co-convenor until June 2020. She is now a co-convenor of the ILPA Family and Personal Migration Working Group. \nNath delivers ILPA’s ‘It’s all about the money: Financial Requirements of Appendix FM’; ‘Sole Responsibility and the Immigration Rules; and “I can’t afford immigration fees” Fee Waivers trainings. She has been a panellist at various ILPA’s conferences and seminars.

DESCRIPTION:This course will focus on settlement (indefinite leave to remain) applications in the family\, private life and other human rights routes\n\n\nLevel: Intermediate \nDescription: \nThis course will focus on settlement (indefinite leave to remain) applications in the family\, private life and other human rights routes including long residence and will also cover EUSS\, UK ancestry and BN(O) Hong Kong applications. It will include consideration of general issues such as Life in the UK/English language requirements\, criminality and other general grounds for refusal\, continuity of residence\, qualifying periods and Covid 19 discretions as well as the mechanics of applications\, appeals and maintaining ILR including returning resident applications. \nThe aim of the course is to provide practitioners with a clear overview of the current measures\, policy guidance and any concessions in place to enable them to fully advise and prepare clients who are applying or considering applying for settlement in family\, private life and other human rights routes. \nAudience: \nThe session is aimed at practitioners either with prior knowledge and experience of family\, private life and other human rights applications who are looking to refine their knowledge of this area of practice or who wish to expand their knowledge of areas which they do not routinely work in. \n\n\nTutors: Emma Cohen\, OTB Legal and Meghan Vozila  Penningtons Manches Cooper \nMeghan and Emma’s training for ILPA has been described as “excellent” with delegates valuing the “useful sharing of experiences“. \nEmma is an associate solicitor at OTB Legal\, a niche immigration law firm in Nottingham. She previously worked in the immigration team at Bindmans LLP for over thirteen years. She covers all areas of immigration\, asylum and nationality law. She has particular interest and experience in complex immigration and nationality cases involving families and children including inter-country adoption and she regularly writes court reports on immigration issues in family cases. Emma qualified as a solicitor in 1995 at Bates\, Wells and Braithwaite where she was later a partner in the immigration department. Although she has spent most of her post qualification experience working in immigration law in private practice Emma has also lectured at Anglia Ruskin University in Cambridge and worked in the voluntary sector. SUMMARY:WEB 1207 Nationality Applications for Children (Webinar)
DESCRIPTION:Practitioners working with children will receive an in-depth look at the ways in which migrant children can register as British citizens.\n\n\nLevel: Intermediate  \nDescription:  \nPractitioners and those working with children will receive an in-depth look at the various ways in which migrant children can register as British citizens. The seminar will look at the statutory requirements under the British National Act 1981\, the Home Office guidance on registration\, including the recent amendments to the guidance for discretionary applications under section 3(1) of the British Nationality Act 1981\, as well as practical considerations for making applications. She decided to start a conversation around well-being among immigration practitioners and collaborated with ILPA to organise its first well-being seminar in May 2018 and was a co-convenor until June 2020. Nath is now a co-convenor of the ILPA Family and Personal Migration Working Group. \nNath has delivered several ILPA training courses including on Appendix FM financial requirements; the EU Settlement Scheme; fee waivers; transnational marriage abandonment; and sole responsibility. DESCRIPTION:We will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences.\n\n\nLevel: Intermediate – Advanced \nDescription: \nThe high level of recent merger\, acquisition and restructuring activity in the UK means practitioners are frequently being asked to advise on the immigration and right to work aspects of corporate transactions.  Where one or more of the entities involved has a sponsor licence\, this will often consist of reviewing the current sponsor licence arrangements\, advising on the appropriate arrangement post-transaction and then taking the necessary steps to ensure that the appropriate entity is able to continue to employ its sponsored workers.  This may involve either making a notification to the Home Office or submitting an application for a new licence.  If the transaction involves staff transferring between entities\, this can also involve right to work issues. \nPractitioners are also frequently required to have an understanding of the types of structures that international companies employ and advise on whether these structures mean that these businesses can transfer their overseas employees to the UK under the Intra-Company routes (including Global Business Mobility – Senior or Specialist Worker and Graduate Trainee).   \nThe course will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences.  It will consider the steps that need to be taken when a company that holds a Skilled Worker sponsor licence is involved in a corporate transaction. She has an MSc in Psychology with research on secondary traumatic stress in the legal profession. This research and ongoing study informs the work of Claiming Space. She is an experienced freelance trainer and group facilitator as well as a meditation and Mindfulness-Based Cognitive Therapy teacher. \nRachel Francis is a barrister practising in immigration and family law with particular expertise in working with vulnerable clients. She is the former co-chair of Young Legal Aid Lawyers. During her time as co-chair\, Rachel saw first-hand the effects of working with trauma in the legal profession. She was jointly responsible for the strategic direction of the group and for co-ordinating its campaigning\, promoting social mobility and protecting the interests of junior lawyers who believe in the importance of legal-aided work as a means of achieving social justice. In July 2019 Rachel was awarded the LAPG Special Award for outstanding commitment to access to justice.

SUMMARY:WEB 1203 Mergers and Acquisitions (webinar)
DESCRIPTION:We will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences.\n\n\nLevel: Intermediate – Advanced \nDescription: \nThe high level of recent merger\, acquisition and restructuring activity in the UK means practitioners are frequently being asked to advise on the immigration and right to work aspects of corporate transactions.  Where one or more of the entities involved has a sponsor licence\, this will often consist of reviewing the current sponsor licence arrangements\, advising on the appropriate arrangement post-transaction and then taking the necessary steps to ensure that the appropriate entity is able to continue to employ its sponsored workers.  This may involve either making a notification to the Home Office or submitting an application for a new licence.  If the transaction involves staff transferring between entities\, this can also involve right to work issues. \nPractitioners are also frequently required to have an understanding of the types of structures that international companies employ and advise on whether these structures mean that these businesses can transfer their overseas employees to the UK under the Intra-Company routes (including Global Business Mobility – Senior or Specialist Worker and Graduate Trainee).   \nThe course will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences.  It will consider the steps that need to be taken when a company that holds a Skilled Worker sponsor licence is involved in a corporate transaction.  Finally\, it will look at the right to work issues that arise from corporate transactions. \nTopics:  \n•    Initial sponsor licence applications\, with a focus on Skilled Worker and Intra-Company routes licences;•    Adding new UK and overseas group entities to a sponsor licence;•    Qualifying types of corporate group structures for the Intra-Company routes;•    Recognising and dealing with common change of ownership scenarios;•    Worked examples of the steps that practitioners should take when notifying the Home Office when a sponsor licence holder is involved in a corporate transaction; and•    Right to work and due diligence issues which arise as a result of corporate transactions. \nAudience: \nThis session is aimed at practitioners who have existing knowledge of sponsor licence applications and are looking to broaden their understanding of corporate structures and the steps that need to be taken from an immigration standpoint before\, during and after the completion of a corporate transaction. \n\n\nTutors: Ilda de Sousa\, Partner and Robert Houchill\, Senior Associate at Kinglsey Napley LLP \nIlda de Sousa is a partner in the immigration team at Kingsley Napley. She is a South African qualified attorney and a British qualified solicitor who joined the firm in January 2010.  \nIlda has over ten years of UK corporate immigration law experience\, managing large company clients as well as handling complex matters for individuals\, British nationality applications\, appeals\, judicial reviews and applications under European Law including Brexit related advice. \nShe has extensive knowledge and experience in all aspects of the Points Based System\, including assisting employers with their Skilled Worker or Temporary Work sponsor registrations and advising on immigration compliance issues. DESCRIPTION:Reviewing the protection afforded by Article 8 European Convention on Human Rights in 2023.\n\n\nLevel: Intermediate – Advanced \nDescription: \nReviewing the protection afforded by Article 8 ECHR in 2023\, in conjunction with a detailed look at the recent changes to the Immigration Rules and recent authorities and policy/statutory changes\, in order to provide practitioners with a practical update on how to prepare their cases relying on family and private life.   \nTopics: \n•    the new immigration rules – Appendix Private Life and Appendix Settlement Family Life  \n•    the relationship between Article 8 and the Immigration Rules and the public interest considerations in the NIAA 2002 (as amended); \n•    entry clearance applications; \n•    ‘insurmountable obstacles’ and family life;  \n•    best interests of children;  \n•    dependent relatives and carers;  \n•    Article 8 and appeals\, including ‘new matters’  \nAudience: The session is aimed at all practitioners who are advising clients on claims relating to their family and private lives. Some familiarity with Article 8 would be useful\, as this is not an introductory course. \n\n\nTutors: Mala Savjani\, Solicitor at Wilson Solicitors for Here for Good and Vijay Jagadesham\, Barrister at Garden Court North Chambers \nMala is a solicitor at Wilson Solicitors LLP for Here for Good. Her practice covers a wide range of immigration\, asylum and nationality law\, with particular emphasis on applications based on partnership\, family and private life; asylum on the basis of sexual identity; and the rights of Europeans and their family members. Mala also volunteers for Waterloo Legal Advice Service and Rainbow Migration and is a volunteer lawyer for the charity “Here for Good”. \nVijay “undertakes a wide range of immigration and asylum work\, most notably on behalf of vulnerable adults and children”(Chambers and Partners\, 2019). Vijay recently returned from his sixth trip to the island of Samos in Greece\, where he provided legal aid to asylum seekers and drafted numerous applications to the European Court of Human Rights in relation to age-disputed unaccompanied minors\, and exceptionally secured “interim measures” against the Greek government in relation to breaches of Article 3 ECHR.  \nVijay regularly engages in age assessment challenges and is particularly well placed to do so in light of his experience in immigration and asylum law and civil litigation\, including actions against the police. Vijay also draws on his significant public law expertise\, including two successful challenges in the Supreme Court\, in bringing public law challenges in relation to all levels of decision-making. He also advises on claims for damages\, under the common law and the HRA 1998. He is a contributor to the 9th edition of Macdonald’s Immigration Law and Practice.
