DESCRIPTION:We will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences.\n\n\nL﻿evel: Intermediate – Advanced \nD﻿escription: \nThe high level of recent merger\, acquisition and restructuring activity in the UK means practitioners are frequently being asked to advise on the immigration and right to work aspects of corporate transactions.  Where one or more of the entities involved has a sponsor licence\, this will often consist of reviewing the current sponsor licence arrangements\, advising on the appropriate arrangement post-transaction and then taking the necessary steps to ensure that the appropriate entity is able to continue to employ its sponsored workers.  This may involve either making a notification to the Home Office or submitting an application for a new licence.  If the transaction involves staff transferring between entities\, this can also involve right to work issues. \nPractitioners are also frequently required to have an understanding of the types of structures that international companies employ and advise on whether these structures mean that these businesses can transfer their overseas employees to the UK under the Intra-Company routes (including Global Business Mobility – Senior or Specialist Worker and Graduate Trainee).   \nThe course will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences.  It will consider the steps that need to be taken when a company that holds a Skilled Worker sponsor licence is involved in a corporate transaction.  Finally\, it will look at the right to work issues that arise from corporate transactions. \nTopics:  \n•    Initial sponsor licence applications\, with a focus on Skilled Worker and Intra-Company routes licences;•    Adding new UK and overseas group entities to a sponsor licence;•    Qualifying types of corporate group structures for the Intra-Company routes;•    Recognising and dealing with common change of ownership scenarios;•    Worked examples of the steps that practitioners should take when notifying the Home Office when a sponsor licence holder is involved in a corporate transaction; and•    Right to work and due diligence issues which arise as a result of corporate transactions. \nA﻿udience: \nThis session is aimed at practitioners who have existing knowledge of sponsor licence applications and are looking to broaden their understanding of corporate structures and the steps that need to be taken from an immigration standpoint before\, during and after the completion of a corporate transaction. \n\n\nT﻿utors: Ilda de Sousa\, Partner and Robert Houchill\, Senior Associate at Kinglsey Napley LLP \nIlda de Sousa is a partner in the immigration team at Kingsley Napley. Vijay recently returned from his sixth trip to the island of Samos in Greece\, where he provided legal aid to asylum seekers and drafted numerous applications to the European Court of Human Rights in relation to age-disputed unaccompanied minors\, and exceptionally secured “interim measures” against the Greek government in relation to breaches of Article 3 ECHR.  \nVijay regularly engages in age assessment challenges and is particularly well placed to do so in light of his experience in immigration and asylum law and civil litigation\, including actions against the police. It covers automatic acquisition of British citizenship by birth or descent\, tracing family status and old Commonwealth cases on and after independence\, other forms of British nationality (e.g.\, British Overseas citizens)\, and dual nationality issues in practice. It also looks at the swing to correct historical injustices based on sex discrimination\, illegitimacy and birth in the British overseas territories.  \nIt considers the nationality legislation of 1914 and 1948 before turning to the development of the British Nationality Act 1981 and its revisions down to the present day. The course includes discussion of relevant changes made by the Nationality and Borders Act 2022. DESCRIPTION:“I can’t afford immigration fees”: how to prepare successful fee waiver applications\n\n\nT﻿his event is open to ILPA members only. If you are not already an ILPA member\, but would like to attend this training\, please contact the ILPA Secretariat about membership (info@ilpa.org.uk). \nThis course wants to be a very practical introduction to immigration fee waiver applications\, for both in country and out of country applications.  \nWe will be talking about who is eligible for fee waivers; how to prepare fee waiver applications; when to submit fee waiver applications; and what to do if an application is refused.  \nBy the end of the course\, attendees will be able to  \n(1) identify at an early stage clients who are eligible for fee waivers;  \n(2) prepare “winning” fee waiver applications;  \n(3) understand the application process; and  \n(4) understand what happens after an application has been decided\, with both positive and negative decisions. \nT﻿opics: \n1.	Eligibility: which applications attract a fee waiver\, and what are the tests to be granted a fee waiver \n2.	Process: how and when to submit the application \n3.	Preparation: what documents are needed and how to best present the evidence \n4.	Decisions: what happens after a positive decision and what happens after a negative decision \nThis course will be relevant to lawyers\, but also non-lawyers\, such as NGOs\, frontline organisations\, legal assistants\, interns\, volunteers etc.\, who support clients to make fee waiver applications. \n\n\nT﻿utors: N﻿ath Gbikpi\, Leigh Day and Juliane Heider\, Islington Law Centre \nNath is a solicitor at Leigh Day Solicitors. Her practice covers a wide range of immigration\, asylum and nationality law\, with particular emphasis on human rights applications\, including complex applications outside of the rules; initial asylum and fresh claims; applications on the basis of domestic abuse and transnational marriage abandonment; and applications by children in care and care leavers.  \nNath also writes regularly for Free Movement\, including case law updates\, briefings and training courses. \nNath co-founded the ILPA Well-being Working Group in 2018 and was a co-convenor until June 2020. She is now a co-convenor of the ILPA Family and Personal Migration Working Group. \nNath delivers ILPA’s ‘It’s all about the money: Financial Requirements of Appendix FM’; ‘Sole Responsibility and the Immigration Rules; and ‘The Phenomenon of Transnational Marriage Abandonment’ trainings. She has been a panellist at  various ILPA’s conferences and seminars. \nJuliane is a solicitor at Islington Law Centre. She has a diverse practice of immigration and asylum claims\, and regularly works with vulnerable clients. With colleagues and Counsel\, much of her current work focuses on issues arising from and challenges to the 10-year route to settlement.

Many thanks.   \n \n\n\nT﻿utors: \nJoanna Fleck is a reflective practice facilitator\, trainee psychotherapist\, and writer. She spent over 10 years working in legal aid\, specialising in actions against the state\, inquests and public inquiries. She has an MSc in Psychology with research on secondary traumatic stress in the legal profession. This research and ongoing study informs the work of Claiming Space. She is an experienced freelance trainer and group facilitator as well as a meditation and Mindfulness-Based Cognitive Therapy teacher. \nRachel Francis is a barrister practising in immigration and family law with particular expertise in working with vulnerable clients. She is the former co-chair of Young Legal Aid Lawyers. During her time as co-chair\, Rachel saw first-hand the effects of working with trauma in the legal profession. She was jointly responsible for the strategic direction of the group and for co-ordinating its campaigning\, promoting social mobility and protecting the interests of junior lawyers who believe in the importance of legal-aided work as a means of achieving social justice. In July 2019 Rachel was awarded the LAPG Special Award for outstanding commitment to access to justice.

DESCRIPTION:This session is aimed at practitioners who would like a grounding in statelessness issues.\n\n\nL﻿evel: Basic – Intermediate  \nD﻿escription: \nThis session is aimed at practitioners who would like a grounding in statelessness issues\, including applying for leave to remain as a stateless person\, routes to acquisition of British citizenship for stateless persons\, and how to evidence  statelessness in the context of removal and unlawful detention. \nFollowing this course practitioners and advisors will be better placed to:  \n\nAdvise and assist foreign nationals to make applications for leave to remain as stateless persons\nAdvise and assist on all aspects of applying for registration as a British citizen\nAdvise and assist on how to evidence statelessness to the required standard in other contexts eg. nationality applications\, removal and detention\nAdvise and assist on legal remedies\n\nPlease note that this course will not cover presenting asylum claims.  \nThis course aims to help busy practitioner to identify where statelessness may be relevant; to advise clients on options and then to access a durable solution. \nA﻿udience: Practitioners who work in the field of statelessness and nationality law\, those experienced in other areas of immigration work who already have some knowledge of statelessness and nationality law\, and those seeking a refresher/update course. \n\n\nT﻿utors: Adrian Berry\, Garden Court Chambers and Judith Carter\, Liverpool Law Clinic \nAdrian Berry is a barrister at Garden Court Chambers and an ILPA Patron. As regards statelessness issues\, he acts and advises in relation to statelessness cases\, including in relation to the 1954 Convention Relating to the Status of Stateless Persons and the 1961 Convention on the Reduction of Statelessness. He works on cases concerning stateless persons in detention\, the regularization of stateless persons\, and the welfare of stateless persons. He has worked with Asylum Aid and the Equal Rights Trust on statelessness issues. He is a member of the Advisory Council of the European Network on Statelessness (ENS). \nJudith Carter is a solicitor and academic who has worked on statelessness leave to remain applications since 2013\, and is the co-author of the ILPA/Uni of Liverpool Best Practice Guide. She maintains the UK Index on Statelessness for the European Network on Statelessness and has worked as an expert for the UNHCR and Council of Europe. She works at the University of Liverpool Law Clinic as a lecturer and solicitor.

DESCRIPTION:Practitioners working with children will receive an in-depth look at the ways in which migrant children can register as British citizens.\n\n\nL﻿evel: Intermediate  \nD﻿escription:  \nPractitioners and those working with children will receive an in-depth look at the various ways in which migrant children can register as British citizens. The seminar will look at the statutory requirements under the British National Act 1981\, the Home Office guidance on registration\, including the recent amendments to the guidance for discretionary applications under section 3(1) of the British Nationality Act 1981\, as well as practical considerations for making applications. It will include an opportunity to participate in case studies of applications under the different routes to registration\, either in groups or led by the tutors. \nThe topics covered will include:  \n–    Registration applications under sections 1(3)\, 1(4)\, 3(2)\, 3(5)\, 4F and 4G \n–    Discretionary applications under section 3(1) \n–    Parental consent and proof of paternity \n–    Application process and supporting evidence  \n*We will not be covering naturalisation or registration applications for adults \nAudience: Practitioners advising families about British nationality options for children or wanting to learn more about this area of law.  \n\n\nT﻿utors: Emma Cohen\, OTB Legal and Ashley Fleming\, Harper Macleod  \nEmma is an associate solicitor at OTB Legal. Prior to joining OTB Legal she was an associate solicitor in the immigration department at Bindmans LLP where she had worked for over ten years. She covers all areas of immigration\, asylum and nationality law.  She has particular interest and experience in complex immigration and nationality cases involving families and children including inter-country adoption and she regularly writes court reports on immigration issues in family cases. Emma qualified as a solicitor in 1995 at Bates\, Wells and Braithwaite.  Although she has spent most of her 25 years post qualification experience working in immigration law in private practice Emma has also lectured at Anglia Ruskin University in Cambridge.  She is a volunteer adviser for Rainbow Migration. \nEmma is a regular trainer for ILPA and had delivered courses on Family Law for Immigration Practitioners\, Indefinite Leave to Remain: all you need to know\, Criminality in the Immigration Rules\, Professional conduct and ethics in immigration cases\, Home Office policy\, concessions & the exercise of discretion outside the rules\, and Discretion – What’s Left? Exploring the use of discretion in immigration and nationality law. \nAshley a senior associate solicitor at Harper Macleod LLP and has over 15 years’ experience working in the field of immigration. Her caseload covers all aspects of immigration\, asylum and nationality law.  \nAshley is a regular trainer for ILPA and has delivered courses on the EU Settlement Scheme\, introductory courses on both immigration and asylum law to MPs’ Caseworkers and Assistants and the Introduction to Immigration Law course for practitioners.
