SUMMARY:WEB 1204 Mergers and Acquisitions (Webinar)
DESCRIPTION:We will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences.\n\n\nLevel: Intermediate – Advanced \nDescription: \nThe high level of recent merger\, acquisition and restructuring activity in the UK means practitioners are frequently being asked to advise on the immigration and right to work aspects of corporate transactions.  Where one or more of the entities involved has a sponsor licence\, this will often consist of reviewing the current sponsor licence arrangements\, advising on the appropriate arrangement post-transaction and then taking the necessary steps to ensure that the appropriate entity is able to continue to employ its sponsored workers.  This may involve either making a notification to the Home Office or submitting an application for a new licence.  If the transaction involves staff transferring between entities\, this can also involve right to work issues. \nPractitioners are also frequently required to have an understanding of the types of structures that international companies employ and advise on whether these structures mean that these businesses can transfer their overseas employees to the UK under the Intra-Company routes (including Global Business Mobility – Senior or Specialist Worker and Graduate Trainee).   \nThe course will explore issues that arise when companies with complex structures apply for Skilled Worker and Intra-Company routes sponsor licences.  It will consider the steps that need to be taken when a company that holds a Skilled Worker sponsor licence is involved in a corporate transaction.  Finally\, it will look at the right to work issues that arise from corporate transactions. \nTopics:  \n•    Initial sponsor licence applications\, with a focus on Skilled Worker and Intra-Company routes licences; \n•    Adding new UK and overseas group entities to a sponsor licence; \n•    Qualifying types of corporate group structures for the Intra-Company routes; \n•    Recognising and dealing with common change of ownership scenarios; \n•    Worked examples of the steps that practitioners should take when notifying the Home Office when a sponsor licence holder is involved in a corporate transaction; and \n•    Right to work and due diligence issues which arise as a result of corporate transactions. \nAudience: \nThis session is aimed at practitioners who have existing knowledge of sponsor licence applications and are looking to broaden their understanding of corporate structures and the steps that need to be taken from an immigration standpoint before\, during and after the completion of a corporate transaction. \n\n\nTutors: Ilda de Sousa\, Partner and Robert Houchill\, Senior Associate at Kinglsey Napley LLP \nIlda de Sousa is a partner in the immigration team at Kingsley Napley. She is a South African qualified attorney and a British qualified solicitor who joined the firm in January 2010. \nIlda has over ten years of UK corporate immigration law experience\, managing large company clients as well as handling complex matters for individuals\, British nationality applications\, appeals\, judicial reviews and applications under European Law including Brexit related advice. \nShe has extensive knowledge and experience in all aspects of the Points Based System\, including assisting employers with their Skilled Worker or Temporary Work sponsor registrations and advising on immigration compliance issues. Equally\, she has extensive experience in advising investors\, entrepreneurs and high-net worth individuals. \nPrior to joining Kingsley Napley LLP\, Ilda was the UK Country Manager for Emigra Europe Limited\, a specialist global immigration consultancy firm\, with service centres on three continents\, providing global immigration services for over 100 different countries. Ilda was responsible for the overall management of the UK office\, including advising large multinational clients in respect of their UK Immigration related matters. \nShe is recommended as a Thought Leader in the 2022 International Who’s Who of Business Immigration Lawyers\, Chambers and Partners\, and is ranked as a Leading Individual in Legal 500 UK 2021. She has also been recognised in the Citywealth Leaders List 2020. \nRobert Houchill has extensive experience of assisting individuals and organisations with their UK immigration and nationality matters. Robert’s experience covers all kinds of immigration and nationality applications but with a particular emphasis on corporate immigration matters\, and helping high net worth individuals. \nRobert often helps organisations with sponsor licence applications and advises on immigration compliance issues. He has also worked with organisations to challenge UKVI decisions following sponsor licence suspensions and revocations. \nPrior to joining Kingsley Napley in March 2019\, Robert worked for five years at law firms in London\, including Gherson and Bates Wells Braithwaite\, and at a Russian law firm in St Petersburg for two and a half years.

DESCRIPTION:It’s all about the money! Together we’ll explore the financial requirements of Appendix FM.\n\n\nLevel: Intermediate  \nDescription: \nAt the end of the course participants should fully understand the financial requirements in Appendix FM and the related evidential requirements in Appendix FM-SE\, and be equipped to handle a range of applications involving different financial circumstances.  \nTopics will cover the requirements for partners and other family members under Appendix FM and Appendix FM-SE\, including:  \n•	calculating level of income/savings required  \n•	permitted sources of income  \n•	specified evidence  \n•	methods of calculating salaried employment\, self-employment\, non-employment income and cash savings \n•	combining sources of income \n•	adequate maintenance test \n•	other sources of income\, financial support or funds and the differing exceptionality tests \n•	case studies \nThe aim of this course is to provide an overview of the financial requirements for partner-based applications for entry clearance and leave to remain made under Appendices FM and FM-SE\, and to explore in detail aspects of those rules. Come prepared with a calculator!  \nAudience: \nThe session is aimed at those who are already practising in this area\, and will assume working knowledge of the structure of Appendix FM within the immigration rules. \n\n\nTutors: Nath Gbikpi\, Leigh Day and Adam Cotterill\, Doyle Clayton Solicitors  \nAdam is a Senior Associate at Doyle Clayton and has over 14 years’ experience in UK immigration law. He is recognised as one of the UK’s leading lawyers and has been ranked as a Rising Star by the Legal 500 for the last four consecutive years. Adam advises both individuals and organisations on the full breadth of UK immigration\, but his focus is on personal immigration in particular applications relating to partners and children. Adam previously worked for 6 years at a Top 100 international law firm and trained and worked for 8 years at a Band 1 boutique immigration law firm. \nNath is an associate solicitor at Leigh Day\, and her practice covers a wide range of immigration\, asylum and nationality law\, with particular emphasis on human rights applications; initial asylum and fresh claims; and applications on the basis of domestic abuse. Nath also writes for Free Movement\, including case law updates; briefings and training courses. \nNath co-founded the ILPA Well-being Working Group in 2018. She decided to start a conversation around well-being among immigration practitioners and collaborated with ILPA to organise its first well-being seminar in May 2018 and was a co-convenor until June 2020. Nath is now a co-convenor of the ILPA Family and Personal Migration Working Group. \nNath has delivered several ILPA training courses including on Appendix FM financial requirements; the EU Settlement Scheme; fee waivers; transnational marriage abandonment; and sole responsibility. Nath has been a panelist at ILPA’s AGM\, Conference on Family Migration to the UK\, Practicing Immigration Law: everything you need to know seminar\, and co-chaired ILPA’s inaugural Well-being conference.

SUMMARY:WEB 1207 Nationality Applications for Children (Webinar)
DESCRIPTION:Practitioners working with children will receive an in-depth look at the ways in which migrant children can register as British citizens.\n\n\nLevel: Intermediate  \nDescription:  \nPractitioners and those working with children will receive an in-depth look at the various ways in which migrant children can register as British citizens. The seminar will look at the statutory requirements under the British National Act 1981\, the Home Office guidance on registration\, including the recent amendments to the guidance for discretionary applications under section 3(1) of the British Nationality Act 1981\, as well as practical considerations for making applications. It will include an opportunity to participate in case studies of applications under the different routes to registration\, either in groups or led by the tutors. \nThe topics covered will include:  \n–    Registration applications under sections 1(3)\, 1(4)\, 3(2)\, 3(5)\, 4F and 4G \n–    Discretionary applications under section 3(1) \n–    Parental consent and proof of paternity \n–    Application process and supporting evidence  \n*We will not be covering naturalisation or registration applications for adults \nAudience: Practitioners advising families about British nationality options for children or wanting to learn more about this area of law.  \n\n\nTutors: Emma Cohen\, OTB Legal and Ashley Fleming\, Harper Macleod  \nEmma is an associate solicitor at OTB Legal. Prior to joining OTB Legal she was an associate solicitor in the immigration department at Bindmans LLP where she had worked for over ten years. She covers all areas of immigration\, asylum and nationality law.  She has particular interest and experience in complex immigration and nationality cases involving families and children including inter-country adoption and she regularly writes court reports on immigration issues in family cases. Emma qualified as a solicitor in 1995 at Bates\, Wells and Braithwaite.  Although she has spent most of her 25 years post qualification experience working in immigration law in private practice Emma has also lectured at Anglia Ruskin University in Cambridge.  She is a volunteer adviser for Rainbow Migration. \nEmma is a regular trainer for ILPA and had delivered courses on Family Law for Immigration Practitioners\, Indefinite Leave to Remain: all you need to know\, Criminality in the Immigration Rules\, Professional conduct and ethics in immigration cases\, Home Office policy\, concessions & the exercise of discretion outside the rules\, and Discretion – What’s Left? Exploring the use of discretion in immigration and nationality law. \nAshley a senior associate solicitor at Harper Macleod LLP and has over 15 years’ experience working in the field of immigration. Her caseload covers all aspects of immigration\, asylum and nationality law.  \nAshley is a regular trainer for ILPA and has delivered courses on the EU Settlement Scheme\, introductory courses on both immigration and asylum law to MPs’ Caseworkers and Assistants and the Introduction to Immigration Law course for practitioners.

With Gemma Tracey he is the author of “Deportation: A Practical Guide” (Law Brief Publishing\, 2021). \nShara has worked in the area of UK immigration with since 2010 and heads up the immigration team within Pinsent Masons UK. She handles sponsor licensing applications for employers as well as other complex Points Based System issues. Shara has comprehensive experience with applications for entrepreneurs/innovators and investors\, and with assisting highly skilled migrants seeking endorsements as ‘Global Talent’. \nShara is a co-convener of the ILPA North West working group.  \nShara delivers ILPA’s ‘Introduction to Business Immigration Law’ and ‘Employing Migrant Workers: Tier 2\, sponsorship & alternatives’ training.

The group meets every 6 weeks and works collectively to create cultural and systemic change within the sector by facilitating workshops\, training and conferences on the topics of mental health\, well-being and vicarious trauma. DESCRIPTION:This course will focus on settlement (indefinite leave to remain) applications in the family\, private life and other human rights routes\n\n\nLevel: Intermediate \nDescription: \nThis course will focus on settlement (indefinite leave to remain) applications in the family\, private life and other human rights routes including long residence and will also cover EUSS\, UK ancestry and BN(O) Hong Kong applications. It will include consideration of general issues such as Life in the UK/English language requirements\, criminality and other general grounds for refusal\, continuity of residence\, qualifying periods and Covid 19 discretions as well as the mechanics of applications\, appeals and maintaining ILR including returning resident applications. \nThe aim of the course is to provide practitioners with a clear overview of the current measures\, policy guidance and any concessions in place to enable them to fully advise and prepare clients who are applying or considering applying for settlement in family\, private life and other human rights routes. \nAudience: \nThe session is aimed at practitioners either with prior knowledge and experience of family\, private life and other human rights applications who are looking to refine their knowledge of this area of practice or who wish to expand their knowledge of areas which they do not routinely work in. \n\n\nTutors: Emma Cohen\, OTB Legal and Meghan Vozila  Penningtons Manches Cooper \nMeghan and Emma’s training for ILPA has been described as “excellent” with delegates valuing the “useful sharing of experiences“. \nEmma is an associate solicitor at OTB Legal\, a niche immigration law firm in Nottingham. She previously worked in the immigration team at Bindmans LLP for over thirteen years. She covers all areas of immigration\, asylum and nationality law. She has particular interest and experience in complex immigration and nationality cases involving families and children including inter-country adoption and she regularly writes court reports on immigration issues in family cases. Emma qualified as a solicitor in 1995 at Bates\, Wells and Braithwaite where she was later a partner in the immigration department. Although she has spent most of her post qualification experience working in immigration law in private practice Emma has also lectured at Anglia Ruskin University in Cambridge and worked in the voluntary sector. She is a volunteer adviser for Rainbow Migration. \nEmma is a regular trainer for ILPA and had delivered courses on Nationality Applications for Children\, Indefinite Leave to Remain: all you need to know\, Criminality and the Immigration Rules\, Family Law for Immigration Practitioners\, Professional conduct and ethics in immigration cases\, Home Office policy\, concessions & the exercise of discretion outside the rules\, and Discretion – What’s Left? Exploring the use of discretion in immigration and nationality law. She has also spoken at ILPA’s conferences on family migration. \nMeghan is a senior associate in Pennington Manches Cooper’s immigration team. Meghan is experienced in all aspects of immigration and nationality law. She provides in-depth advice to a range of clients including SMEs\, large multinationals\, high-net-worth individuals\, high-profile celebrities\, tech firms and entrepreneurs. Meghan has particular knowledge of complex European and UK nationality matters and regularly assists both private and corporate clients with tailored solutions. \nIn addition to being recognised by Who’s Who Legal and The Legal 500 as an expert in UK corporate immigration\, Meghan has also been highlighted in Spear’s 500 as a leading private client adviser. She is an active member of the Immigration Law Practitioners Association and regularly provides immigration training for HR and recruitment teams and other practitioners.

DESCRIPTION:This webinar will look at the phenomenon of transnational marriage abandonment & how lawyers can assist stranded spouses to return to the UK\n\n\nThis event is open to ILPA members only. If you are not already an ILPA member\, but would like to attend this training\, please contact the ILPA Secretariat about membership (info@ilpa.org.uk). \nThe webinar will look at the phenomenon of transnational marriage abandonment\, a form of domestic abuse which involves migrant women being deliberately stranded abroad\, and how immigration lawyers can assist stranded spouses to return to the UK.  \nTopics: \n1)    The phenomenon of transnational marriage abandonment: what is it and what common experiences are reported by stranded spouses \n2)    Litigation relating to the phenomenon of transnational marriage abandonment: what has been done in family law and immigration law\, including the recent case of AM v SSHD \n3)    Assisting victims of transnational marriage abandonment to return to the UK: theory and practice    \nThe aim of this course is to raise awareness regarding the phenomenon of transnational abandonment; discuss the ways of assisting victims with their immigration matters; and share experiences with assisting stranded spouses to return to the UK.  \n\n\nLevel: Beginner – Intermediate  \nAudience: Immigration law practitioners and others working with migrant victims of domestic abuse. \nTutors:  Pragna Patel\, Southall Black Sisters and Nath Gbikpi\, Leigh Day  \nPragna is a founding member of the Southall Black Sisters (SBS) and Women Against Fundamentalism. She worked as a co-ordinator and senior case worker for SBS from 1982 to 1993 when she left to train as a solicitor. In 2009 she returned to SBS as its Director. She has been centrally involved in some of SBS’ most important cases and campaigns around domestic violence\, immigration and religious fundamentalism. She has also written extensively on race\, gender and religion. \nPragna and her colleagues at SBS have been leading campaigns to raise awareness of transnational marriage abandonment and to reform family and immigration law\, policy and practice to address the needs of survivors. They have trained family law judges\, worked with the previous President of the Family Division and have brought together immigration law practitioners  to form a working group to work with the Home Office with a view to reforming immigration law.  \nNath is a solicitor at Leigh Day Solicitors. Her practice covers a wide range of immigration\, asylum and nationality law\, with particular emphasis on human rights applications\, including complex applications outside of the rules; initial asylum and fresh claims; applications on the basis of domestic abuse and transnational marriage abandonment; and applications by children in care and care leavers.  \nNath also writes regularly for Free Movement\, including case law updates\, briefings and training courses. \nNath co-founded the ILPA Well-being Working Group in 2018 and was a co-convenor until June 2020. She is now a co-convenor of the ILPA Family and Personal Migration Working Group. \nNath delivers ILPA’s ‘It’s all about the money: Financial Requirements of Appendix FM’; ‘Sole Responsibility and the Immigration Rules; and “I can’t afford immigration fees” Fee Waivers trainings. She has been a panellist at various ILPA’s conferences and seminars.
