DESCRIPTION:Book tickets here  \nLevel: Basic – Intermediate \nWith the move to digital immigration status and delays to the rollout of eVisas\, there have been some significant changes within the prevention of illegal working framework and to the process that employers need to follow to carry out right to work checks. Supporting businesses to remain compliant with their prevention of illegal working obligations is a key component of a business immigration lawyer’s day to day work and it is important that you are familiar with the requirements and the consequences of failing to carry out right to work checks correctly. \nWith this in mind\, this session will take you through what employers need to know to ensure they remain compliant with their prevention of illegal working obligations. It will cover why right to work checks are important\, the process for carrying out right to work checks\, and the consequences for employers if they fail to do so. It will address the employment law considerations that weigh into decision making in this area and how to manage instances of illegal working and dismissals. It will also touch on how the civil penalty scheme works when instances of illegal working arise. A former solicitor\, she spent over 10 years working in legal aid\, specialising in actions against the state\, inquests and public inquiries. She has an MSc in Psychology with research on secondary traumatic stress in the legal profession. This research and ongoing study informs the work of Claiming Space. She is an experienced freelance trainer and group facilitator as well as a meditation and Mindfulness-Based Cognitive Therapy teacher. \nRachel Francis is a barrister practising in immigration and family law with particular expertise in working with vulnerable clients. She is the former co-chair of Young Legal Aid Lawyers. During her time as co-chair\, Rachel saw first-hand the effects of working with trauma in the legal profession. She was jointly responsible for the strategic direction of the group and for co-ordinating its campaigning\, promoting social mobility and protecting the interests of junior lawyers who believe in the importance of legal-aided work as a means of achieving social justice. In July 2019 Rachel was awarded the LAPG Special Award for outstanding commitment to access to justice.

The seminar will look at the statutory requirements under the British National Act 1981\, the Home Office guidance on registration\, as well as practical considerations for making applications. It will include an opportunity to participate in case studies of applications under the different routes to registration\, either in groups or led by the tutors. \nThe topics covered will include: \n– Registration applications under sections 1(3)\, 1(4)\, 3(2)\, 3(5)\, 4F and 4G \n– Discretionary applications under section 3(1) \n– Parental consent and proof of paternity \n– Application process and supporting evidence \n*We will not be covering naturalisation or registration applications for adults \nAudience: Practitioners advising families about British nationality options for children or wanting to learn more about this area of law. \nTutors: Emma Cohen\, OTB Legal and Ashley Fleming\, Harper Macleod LLP \nEmma is an associate solicitor at OTB Legal\, a niche immigration law firm in Nottingham. She previously worked in the immigration team at Bindmans LLP for over thirteen years. She covers all areas of immigration\, asylum and nationality law. She has particular interest and experience in complex immigration and nationality cases involving families and children including inter-country adoption and she regularly writes court reports on immigration issues in family cases. Emma qualified as a solicitor in 1995 at Bates\, Wells and Braithwaite where she was later a partner in the immigration department. Although she has spent most of her post qualification experience working in immigration law in private practice Emma has also lectured at Anglia Ruskin University in Cambridge and worked in the voluntary sector. She is a volunteer adviser for Rainbow Migration. \nEmma is a regular trainer for ILPA and had delivered courses on Nationality Applications for Children\, Indefinite Leave to Remain: all you need to know\, Criminality and the Immigration Rules\, Family Law for Immigration Practitioners\, Professional conduct and ethics in immigration cases\, Home Office policy\, concessions & the exercise of discretion outside the rules\, and Discretion – What’s Left? Exploring the use of discretion in immigration and nationality law. She has also spoken at ILPA’s conferences on family migration. \nAshley is a partner at Harper Macleod LLP and has over 15 years’ experience working in the field of immigration.
