SUMMARY:WEB 3155 Challenging Civil Penalties
DESCRIPTION:Book tickets here \nAn overview of civil penalties including what measures can be taken to potentially challenge decisions and the legal process of appeals. \n\n\n\n\nWith a surge in the number of civil penalties being issued for illegal working\, as well as the maximum penalty now being £60\,000 per worker\, and with the planned extension of the right to work scheme to contractors and the GIG economy\, immigration practitioners might expect clients to encounter civil penalties more often. In response to the changing regulatory environment\, this course will seek to provide: \n· an overview of the law behind civil penalties \n· who the proposed right to work regime might cover \n· tips on engaging with the Home Office to potentially challenge civil penalties \n· the deadlines and timings to respond and challenge a civil penalty \n· what potential grounds there might be to challenge a civil penalty \n· a summary of the appeals process \n· litigation risks \npractical tips and case study examples \n\n\n\n\nTutors: Allan Briddock\, One Pump Court and Robert Houchill\, Kingsley Napley \nAllan Briddock is a barrister at One Pump Court and has been instructed on dozens of civil penalty cases in the past decade. He has vast practical experience which is invaluable in defending civil penalties and has trained several business immigration firms on how to challenge civil penalties. \nRobert Houchill has extensive experience of assisting individuals and organisations with their UK immigration and nationality matters. Robert’s experience covers all kinds of immigration and nationality applications\, but with a particular emphasis on corporate immigration matters\, and helping high net worth individuals. \nRobert often helps organisations with sponsor licence applications and advises on immigration compliance issues. He has also worked with organisations to challenge UKVI decisions following sponsor licence suspensions and revocations. \nPrior to joining Kingsley Napley in March 2019\, Robert worked for five years at law firms in London\, including Gherson and Bates Wells Braithwaite.

The session will offer practical advice and answer frequently asked questions into what can be a very unique immigration application process. At the end of the session\, delegates should be in a better position to advise their clients on their options and likelihood of success as well as guiding them on the overall process. \nAudience: Aimed at intermediate and advanced practitioners. While the course will summarise the basic requirements of the route\, the focus will be on the specifics of the Global Talent route and a certain level of knowledge will be expected. \nType of Course: Overview \nAim of Course: Enhance knowledge of the category for practitioners \nTutors: Anushka Sinha\, Lee and Thompson LLP and Katie Newbury\, Kingsley Napley \nAnushka is an Legal Director who specialises in all areas of business and personal immigration to the UK. She provides strategic personal and business immigration advice to individuals and companies on the points-based system and other immigration categories. She is actively involved in challenging Home Office policies through her work with the Immigration Law Practitioners Association. She has previously met with Immigration Ministers and senior policymakers on several occasions to discuss changes to the UK immigration system and policies. \nKatie is a Partner in the immigration team and has over 10 years’ experience across a wide spectrum of UK immigration matters\, with particular expertise in applications made under Tier 1 of the Points Based System and complex personal immigration matters. She regularly provides commentary on the workings of the UK Immigration Rules and is often involved in lobbying the Home Office\, including in relation to the design of a future post-Brexit UK immigration system.
