Levels: Intermediate to Advanced
Audience: This course will cover complex law on detention and applications for a writ of habeas corpus. It will assume knowledge of the fundamentals of immigration detention, and some familiarity with judicial review and Administrative Court procedure. It is better suited to a more advanced audience, particularly one with some familiarity challenging immigration detention.
Aim of the course: This course will aim to equip practitioners with an understanding of the law regarding applications for a writ of habeas corpus, and the possible legal debates around the scope of the remedy and how it might be deployed in the new context of the Illegal Migration Act 2023.
