Clause 12, dealing with procedures before the Special Immigration Appeals Commission is debated from col 259, with reference made to ILPA’s briefing. Judicial review decisions relating to certain exclusions of non-European economic area nationals from the United Kingdom that were made wholly or partly on the grounds that their presence would not be conducive to the public good, as well as certain decisions to refuse to naturalise or register a person as a British citizen are to be transferred to the Special Immigration Appeals Commission.  These and cases already dealt with by the Commission do not benefit from the same protections that closed material procedures enjoy in the civil courts.
