DA & Ors v SSHD [2020] EWHC 3080 (Admin)

This case concerns asylum screening interviews. Mr Justice Fordham granted interim relief to the effect that “asylum screening interviews in all cases must involve the asking of question 3.1 (why have you come to the UK?) and question 3.3 (please outline your journey to the UK?).”

It is important that those conducting screening interviews enquire about the journey that people took to get to the UK. This is because there are particular risk indicators associated with e.g. transit through Libya and, if risk indicators are present, the SSHD should refer the asylum seeker to the National Referral Mechanism (NRM).

The rolled-up hearing is to be held on 16 and 17 December.
