The Upper Tribunal held that where a person is to be punished because they refuse to perform military service that would or might involve acts contrary to the ‘basic rules of human conduct’, that could amount to “being persecuted” on grounds of political opinion. However, it should be noted that conscripts have to be ‘sufficiently directly and reasonably plausibly’ connected to the particular acts which limits the scope for protection on this ground.
