Statement of Consensus, November 2025

We, the undersigned, as practitioners and researchers working in UK migration and asylum law, collectively observe the following issues with the UK Government’s asylum policy announcements which were presented to the House of Commons on 17th November 2025, and published with the title “Restoring Order and Control: A statement on the government’s asylum and returns policy”. We are worried about the evidential foundations of the proposed policies and the effects that they will have on the UK’s compliance with its international law obligations and with domestic constitutional norms, as well as the values of justice, decency and fairness. The plans will also harm the ability of UK administrative bodies such as the Home Office to provide prompt and effective services. 

The purpose of this statement of consensus is to highlight our concerns regarding these proposals in the hope that the government might return to valuing evidence-based policy and, accordingly, abandon the proposed Policy Paper which will exacerbate, rather than address, the current challenges facing the UK asylum system.  

We collectively agree that:  

1. The Universal Declaration of Human Rights recognises the right to seek asylum in other countries. Multiple international instruments which the UK has signed proclaim non-refoulement obligations.Moreover, Article 31 of the Refugee Convention, to which the UK is a state party, states that refugees should not be penalised for their ‘illegal’ entry or presence. 

2. ‘Illegal migration’ is a state-produced label, and its usage to refer to asylum-seekers is incompatible with the right to seek asylum. The government’s focus should instead be on the general introduction of safe routes to the UK for the purposes of claiming asylum without the application of arbitrary caps.  

3. The Danish immigration and asylum policy reforms have come at the cost of espousing populist, unfair measures, underpinned by racist policies currently being challenged before the Court of Justice of the EU (Case C-417/23). 

4. The UK hosts a disproportionately low number of individuals seeking asylum and refugees. For example, the UK saw applications relating to 111,084 individuals in the year to June 2025 compared with more than 200,000 applications in Germany. Elsewhere in Europe, Spain, France and Italy also saw more applications than the UK. Globally, the great majority of displaced people are in countries neighbouring those of their nationality such as Bangladesh, Pakistan, Uganda, and Turkey. 

5. The foreword produced by PM Keir Starmer that there is ‘a strong and perverse incentive for migrants who have arrived legally to switch into the asylum system once here’ is unsupported by the evidence: claiming asylum in the UK remains a desperate, last resort measure, with the loss of one’s passport, the need to live on extremely limited financial resources, and the risk of spending 10-15 years embroiled in inefficient procedures and, ultimately, receiving an unfair decision. 

6. There is no evidence of asylum ‘forum shopping’; on the contrary, trying to reach the UK is mostly prompted by family links, language, and past colonial ties. 

7. The use of ‘visa penalties’ for certain countries is a blanket arbitrary measure and unnecessarily punitive.  

8. The strain on the ‘wider social contract’ is due to the prohibition on asylum-seekers entering work; in fact, there is longstanding evidence of the benefits of granting the right to work to asylum seekers, and there is no evidence that refugees prefer to remain in the ‘Core Protection Route’. What makes the UK a more divided place is economic inequality produced by insufficient investment in local and public services, combined with toxic populist discourses. To unite the country, focus should remain on promoting social and economic justice and providing education, not limiting the rights and wellbeing of a small minority of people in need of international protection. 

9. The creation of a twin track route with opportunities for earlier settlement and family reunion only for those in work and study will discriminate against the most vulnerable refugees and those with caring responsibilities.  

10. The suggestion that the UK should seek to reduce the effectiveness of Article 3 of the European Convention on Human Rights (protection against torture or inhuman or degrading treatment) is alarming, given its central role in ensuring that there are some acts which should never be treated as acceptable. 

11. The proposal to render refugee status ‘temporary’ replicates previously scrapped policies and is a new iteration of the policy introduced by the Conservative government under the Nationality and Borders Act 2022, which was widely criticised at the time and promptly reversed. 

12. The requirement to reapply for retention of refugee status at intervals of 2.5 years means that people with refugee status will be in a state of ongoing, prolonged uncertainty, harming their integration and mental health. It will also require conducting tens of thousands of unnecessary re-assessments each year, thereby significantly undermining the capacity of the Home Office and exacerbating decision backlogs, heightening the likelihood of poor-quality decisions overturned at appeal, and extending considerably the costs of the asylum system.  

13. The proposed quadrupling of the residence period before refugees can apply for settlement, from 5 to 20 years, is significantly out of step with global norms and would have disastrous impacts on the health and well-being of refugees as well as on community cohesion. It is incompatible with the obligation in Article 34 of the Refugee Convention to ‘as far as possible facilitate the assimilation and naturalization of refugees’ and ‘in particular make every effort to expedite naturalization proceedings…’. It also disregards that integration – along with resettlement and return – is one of the three main solutions for displacement, as advocated by the UNCHR. Leaving recognised refugees in a limbo for 20 years is, in fact, counter-productive in terms of promoting integration. 

14. There is no reliable body of evidence suggesting that changes to reception conditions have any measurable effect on where people seek asylum. There is, in fact, an extensive body of evidence suggesting that reception conditions have very little effect. For example, in the 2017 Crossing the Mediterranean Sea By Boat Report, reception was rarely given as a reason for the choice of destination in a sample of more than 250 interviews.  At any rate, reception conditions, as confirmed by multiple reports, are in fact of poor quality, owing to profit-maximisation efforts by private providers. 

15. The attempted reform of the appeals procedures shows disregard for the rule of law and fair legal process and misunderstands the reality of legal proceedings. Rather than reducing the right of appeal and accelerating procedures at the cost of claimants’ rights, the focus should be placed on increasing the capacity of the Home Office by investing in the training and resources available to Home Office case workers and improving the quality of decision-making. Increasing capacity through the introduction of ‘professionally trained adjudicators’ is not reassuring without further details of the qualifications of those professionals and the availability of independent legal representation, considering the current issues with the decision-making of the Home Office. 

16. The proposed changes to family reunification rules risk being incompatible with Article 8 of the European Convention on Human Rights. The evidence cited in the statement does not support the assertion that ‘Article 8 rights are currently leading to high numbers of arrivals from those who would not otherwise have the right to live in the UK’. As per MA v Denmark no 6697/18 (GC) (9 July 2021), the European Court of Human Rights has said that refugees need a ‘more favourable’ family reunion policy than that available to other migrants because they cannot return to their home country. 

17. The proposed changes will undermine the capacity of the Home Office, immigration and asylum lawyers, and appellate bodies, reducing the ability of these institutions to process claims in a fair and timely manner and therefore increasing the costs of the asylum system. 

18. Using the ‘late disclosure’ of facts and evidence should not unreasonably undermine a claimant’s credibility, as there may be many good reasons for such lateness. Indeed, some of the causes of lateness lie in existing UK asylum policy. For example, the lack of accessible legal aid in many parts of the UK means that many people only become aware of their legal rights at a late stage in the asylum process.  

19. Using Artificial Intelligence, such as ‘facial age estimation technology’ in the context of international protection claims, is highly problematic from an ethical perspective and not underpinned by accurate and robust evidence, so it should be abandoned for the time being. Its usage may risk the legality of decisions and could lead to increased challenges and associated costs.  

20. The introduction of safe routes is a welcome step but including a cap is counterproductive. People-smuggling is only a profitable illegal activity because of the lack of safe alternatives. The only safe  alternative is to set up a fair and efficient humanitarian visa system.  

21. Private sponsorship, while positive, should never be a substitute to a state-led and funded system of international protection. Having private sponsorship as the main means of international protection in the UK is tantamount to privatising international protection, which, as evidenced by Canada, has produced dubious compliance with its human rights and humanitarian obligations.  

22. If the Government is truly concerned about the impact of conflicts around the world, it should focus on the UK’s development policy – the budget for which has been slashed – and diplomatic and peace efforts to ameliorate the human rights situation in areas from which most asylum-seekers originate. 

23. Attempts to reform the asylum system, based on similar mechanisms to the ‘French return pilot’, have proved disastrous in other contexts, such as the EU-Turkey statement, where dangerous sea journeys still take place and refugees remain trapped in situations of human rights violations. 

24. Outsourcing the UK’s international protection obligations to third countries through mechanisms such as ‘return hubs’ is a neo colonial policy that is not compatible with the mutual respect that all countries owe each other. Instead, countries should collaborate to eliminate the causes of displacement and protect people currently displaced.
